The central goal of this paper is to investigate the injustices that can occur with the use of new technologies, especially Artificial Intelligence (AI), focusing on the issues concerning respect to human rights and the protection of victims and the most vulnerable. We aim to study the impacts of AI in daily life and the possible threats to human dignity imposed by it, such as discrimination based on prejudices, identity-oriented stereotypes, and unequal access to health services. We characterize such cases as algorithmic injustices. In the final part of the text, we propose some strategies to confront this specific type of injustice.

The main aim of this paper is to propose the inclusion of the expertise of a prudent agent in the reflective equilibrium procedure, adding a disposition to identify reasonable beliefs that would be seen as the starting point of the method, which could avoid the criticism of conservatism and subjectivism. To do so, I will begin by analyzing the central characteristics of the method and its main faults. Afterwards, I will investigate the characteristics of prudence as a disposition to identify the adequate means to achieve a good end. With this in mind, I will apply prudence to the procedure, so that it will be carried out by an agent who deliberates well, identifying reasonable moral beliefs and, then, we must justify them based on their consistency with ethical principles and with the factual beliefs of relevant scientific theories. Finally, I will argue that this deliberative process is consistent with ethical pluralism and democracy, and can be taken as a kind of moral knowledge.

This chapter argues that the Covid-19 pandemic has exposed the limits of the mainstream individualistic notion of resilience and, in light of these limits, it advances a new, relational notion of the concept of resilience that contributes to the individuals’ well-being and takes into consideration the role of systemic inequality. The first half of the paper argues that the individualistic notion is flawed in two ways: i) it can foster ill-being because it is cognitively taxing, and ii) it discounts systemic inequality because it transfers the responsibility of any achievement and failure onto the single individual without regard for conditions of oppression. The second half of the paper reconceptualizes the concept of resilience as a relational notion that takes into account structural support as well as conditions of oppression and marginalization. According to this latter notion of resilience, the chapter argues that oppression, lack of material conditions, or lack of structural support are elements that can impact the appropriateness of calls to be resilient. A relational notion of resilience fosters well-being because it puts the collective community at the center (instead of the individual) and it takes into consideration material conditions and structural injustices

O objetivo deste artigo é investigar o escopo do método do equilíbrio reflexivo e sua relação com o conhecimento moral, refletindo sobre o papel deste método na teoria da justiça como equidade de John Rawls. Para tal, iniciamos mostrando a influência do método na filosofia moral e política. Depois, a investigação tem por foco analisar a importância do equilíbrio reflexivo na teoria rawlsiana, destacando o uso do equilíbrio reflexivo estreito e amplo sobretudo nas obras “Outline of a decision procedure for ethics”, A Theory of Justice e “The independence of moral theory” e o uso do equilíbrio reflexivo geral e pleno nas obras Justice as Fairness,Political Liberalism, “Reply to Habermas” e The Law of Peoples. Na parte final do texto, a ideia é defender o equilíbrio reflexivo como um método bastante adequado para a obtenção da objetividade das crenças éticas, podendo ser interpretado como um tipo de conhecimento moral.

O objetivo central desse artigo é refletir sobre o papel e o significado do critério de justiça no pensamento de Adam Smith, considerando especialmente a obra The Theory of Moral Sentiments e, parcialmente, as obras Lectures on Jurisprudence e An Inquiry into the Nature and Causes of the Wealth of Nations. O propósito básico é tentar esboçar uma teoria da justiça que pode ser encontrada nas obras de Smith, particularmente no seu texto de 1759, a saber, The Theory of Moral Sentiments. Para tal, inicio esclarecendo alguns conceitos centrais de sua teoria moral sentimentalista, a saber, empatia, espectador imparcial e mão invisível. Posteriormente, investigo o papel das virtudes nesta teoria normativa anti-utilitarista e a distinção entre virtudes positivas e negativas. De posse disso, o próximo passo será analisar a concepção de justiça retributiva defendida por Smith, que parece defender uma teoria híbrida da punição por englobar aspectos retributivista, preventivista, expressivista e reabilitacionista. Por fim, reflito sobre o significado da justiça como virtude negativa e sua ligação com os direitos.

Para tal finalidade, inicio esclarecendo as características centrais da moralidade, ressaltando a sua natureza e autoridade normativa intersubjetiva. Morals and Law: a peculiar relationship Abstract: The main aim of this paper is to defend the existence of a peculiar pluridirectional relationship between morals and law, as well as to defend that morality is better understood by its normative authority in second person, specifically in cases involving claims of justice. To this end, I begin by clarifying the central characteristics of morality, highlighting its nature and its normative authority that is intersubjective. Subsequently, I investigate two claims of justice, namely, epistemic injustice and civil disobedience. In conclusion, I suggest a distinction between private and public morality, arguing that this can help us to better understand that there is a pluridirectional relationship between morals and law. Para ello, comienzo por aclarar las características centrales de la moral, destacando su naturaleza y su autoridad normativa que es intersubjetiva. Posteriormente, investigo dos reclamos de justicia, a saber, la injusticia epistémica y la desobediencia civil. En conclusión, sugiero una distinción entre moralidad privada y pública, argumentando que esto puede ayudarnos a comprender mejor que existe una relación pluridireccional entre moral y derecho. The aim of this paper is to identify how the ethical-political foundation of human rights in John Rawls’s theory of justice makes use of a coherentist model of moral justification in which cognitivism, liberalism, pluralism, non-foundationalism, and mitigated intuititionism stand out, leading to a pragmatic model of foundation with public justification in The Law of Peoples. The main idea is to think about the reasonableness of the universal defence of human rights as primary goods with the aspects foliows: its political nature, not metaphysical; its theoretical coherentist model, non-foundationalist; its pragmatic function and its public justification.

We are pleased to present to the Brazilian and international philosophical community the third number of the twenty-one volume of Unisinos Journal of Philosophy, which consists of eight articles and one book review. The excellent articles published in this number deal with varied topics, such as the moral dimension of torture, the indispensability of i-desires, the belief and pluralistic ignorance, the influence of Hume’s theory of passions on Smith’s moral theory, the priority of injustice, the strength of the ethics of alterity, an objection to Chalmers’s conceivability argument and an objection against Searle’s ontological subjectivity of consciousness thesis. It also has an important review that analyzes tyranny in Plato’s Republic.

In this paper I want to show the importance of the concept of reasonableness in John Rawls’s theory of justice as fairness, as well as explain the problem of reasonableness in this theory. The starting point will be to stress the requirement of reasonableness that is made to the moral agent in justice as fairness. Later, I will identify some criticism about these criteria. I will show the criticism made by Estlund about the insularity of the concept of reasonableness and the necessity of truth for justification, and the criticism established by Timmons and Gaus regarding the requirement of reasonableness as excessive and ineffective too. In the next step, I shall try to respond to these criticisms and, at the end of this paper, I shall lay down an argument about a kind of reasonable moral responsibility that may be contained in justice as fairness.

Meu objetivo central nesse artigo é procurar refletir sobre uma concepção específica de responsabilidade moral que pode ser derivada de uma ética das virtudes que tem como foco central da avaliação moral os traços de caráter do agente. Para tal, eu ressaltarei inicialmente algumas características centrais do modelo da ética das virtudes em contraposição aos modelos deontológico e consequencialista. Posteriormente, ressaltarei o aspecto internalista da ética das virtudes, com destaque para as características de motivação e deliberação. Por fim, identificarei e problematizarei sobre um tipo de responsabilidade moral abrangente que estaria pressuposta nesse modelo ético.

O objetivo central do artigo é argumentar que estar comprometido com a realidade social não implica necessariamente um comprometimento metafísico mais robusto do que estar comprometido com a realidade individual. Também, defenderemos que este comprometimento ontológico estará restrito ao compromisso com certos postulados de uma teoria política. Para tal, iniciamos com o questionamento sobre o significado da identidade pessoal. Posteriormente, defendemos a necessidade de se contar com a identidade coletiva e a intencionalidade coletiva para melhor lidar com a complexidade moral. A seguir, problematizamos a existência mesma do livre-arbítrio. Por fim, postulamos uma distinção entre uma ontologia de primeira natureza de uma ontologia de segunda natureza, defendendo que o comprometimento com uma ontologia social que resguarda a dimensão individual parece mais adequada à nossa sensibilidade moral e política e, por isso, deveria ter prioridade na formulação de uma teoria política.

O objetivo central deste artigo é refletir sobre a importância da conexão entre virtudes privadas e virtudes públicas de forma coerente para a garantia tanto da estabilidade psicológica como da social, visando ao fortalecimento da democracia. Para tal fim, investigo o papel das virtudes públicas da razoabilidade e tolerância. Posteriormente, tematizo a importância da identidade coletiva e da intencionalidade comum para lidar com a complexidade moral e política, bem como ressalto a característica intersubjetiva do conhecimento moral. O passo seguinte é investigar a relevância das virtudes privadas de integridade e autonomia. Termino o texto defendendo a vantagem de se usar uma teoria liberal-comunitarista que pode conectar coerentemente as virtudes privadas e as públicas, como forma de identificar mais claramente quais seriam as nossas obrigações comuns. O objetivo central desse artigo é apresentar uma posição cognitivista e contextualista no que diz respeito à atribuição de significado dos conceitos normativos de ‘dever’, ‘correto’ e ‘errado’ usados em sentenças cotidianas. Argumentaremos que esses conceitos normativos são melhor compreendidos em termos de razões para agir. Após várias distinções iniciais de esclarecimentos, apontaremos para uma estratégia naturalizada da normatividade não reducionista, bem como para um procedimento de isolamento visando a justificação dos juízos normativos. Por fim, defenderemos que a atribuição de verdade aos juízos normativos se dará em um âmbito de convergência prática.

Resumo: O objetivo central deste artigo é procurar compreender a concepção normativa híbrida usada por John Rawls para justificar moralmente a punição legal, fazendo uso de um recurso consequencialista, a fim de justificar a instituição da punição, isto é, a eficácia social e um recurso retributivista para justificar os atos punitivos particulares, ou seja, a culpa do agente. Analisaremos, especialmente, o artigo "Two Concepts of Rules" e o livro A Theory of Justice. Defenderemos que Rawls faz uso de uma visão liberal de punição, bem como utiliza o método de equilíbrio reflexivo, estipulando uma regra para aprovação da punição legal, a partir da coerência com nossos juízos morais ponderados, o que parece reconciliar a justiça retributiva com a justiça distributiva.2: The principal aim of this paper is to understand the hybrid normative concept used by John Rawls to morally justify legal punishment. Rawls uses a consequentialist argument - that is, social efficacy - to justify the institution of punishment, and a retributivist argument - that is, the guilt of the agent - to justify particular acts of punishment. The article "Two Concepts of Rules" and the book A Theory of Justice are analyzed. We argue that Rawls uses a liberal view of punishment, as well as the method of reflective equilibrium, stipulating a rule for approval of legal punishment based on its coherence with our considered moral judgments; this seems to reconcile retributive justice with distributive justice.

RESUMO Neste artigo pretendemos mostrar as vantagens do modelo epistemológico coerentista quando aplicado ao universo moral. O ponto de partida será apontar que a justificação da crença moral é dada pela coerência com um sistema coerente de crenças que é consistente e que isso pretende resolver o problema da dicotomia entre fato e valor. Posteriormente, apresentam-se as características centrais do coerentismo holístico e investiga-se o método do equilíbrio reflexivo. O próximo passo será fazer referência a três conhecidas objeções ao coerentismo, a saber: o problema do isolamento, os sistemas coerentes alternativos e a circularidade viciosa. Por fim, procuramos responder a essas objeções apelando para os seguintes argumentos: holismo social, razoabilidade e estabilidade social. ABSTRACT In this paper we aim to demonstrate the advantages of the epistemological coherentist model when applied to the moral sphere. The starting point will be to show that the justification of moral belief is a matter of how beliefs fit together with a coherent system of beliefs that is consistent and that it tries to solve the issue of the fact/value dichotomy. Following this, we shall point out the core characteristics of the holistic coherentism and we will investigate the reflective equilibrium method. Next step is to show three standard objections to coherentism, namely, the isolation problem, the alternative coherent systems objection and the vicious circularity. Finally, we shall then try to respond these criticisms with the following arguments: social holism, reasonableness and social stability
