In the case of an irrelevant error in persona, the actor is in control of the objective violation of the norm of conduct at the time of that violation. Accordingly, this violation can be imputed to him directly as intentionally consummated. In the case of a relevant aberratio ictus, the actor is not in control of the objective violation of the norm of conduct. Consequently, this violation can only be imputed to him indirectly under certain conditions, for example as negligent homicide. The fact that the actor thought he would cause prohibited harm to another object than he actually harmed is not enough to permit direct imputation of the norm violation, but rather only to support the assumption of an attempt. Im Falle eines unbeachtlichen error in persona beherrscht der Täter den objektiven Verstoß gegen die Verhaltensnorm aktuell. Dieser Verstoß kann ihm daher ordentlich zugerechnet werden. Es liegt eine vollendete Vorsatztat vor. Im Fall einer beachtlichen aberratio ictus beherrscht der Täter den objektiven Verstoß gegen die Verhaltensnorm nicht. Der Normverstoß ist dem Täter daher höchstens bei Vorliegen der entsprechenden Voraussetzungen außerordentlich zurechenbar. Es liegt dann z.B. eine fahrlässige Tötung vor. Daß der Täter sich vorgestellt hat, einen Erfolgseintritt bei einem anderen als dem tatsächlich getroffenen Tatobjekt herbeizuführen, rechtfertigt nicht eine ordentliche Zurechnung des tatsächlich vorliegenden Verstoßes gegen die Verhaltensnorm, sondern nur die Annahme eines versuchten Delikts
