Since Barry Stroud's classic paper in 1968, the general discussion on transcendental arguments tends to focus on examples from theoretical philosophy. It also tends to be pessimistic, or at least extremely reluctant, about the potential of this kind of arguments. Nevertheless, transcendental reasoning continues to play a prominent role in some recent approaches to moral philosophy. Moreover, some authors argue that transcendental arguments may be more promising in moral philosophy than they are in theoretical contexts. Against this background, the current volume focuses on transcendental arguments in practical philosophy. Experts from different countries and branches of philosophy share their views about whether there are actually differences between "theoretical" and "practical" uses of transcendental arguments. They examine and compare different versions of transcendental arguments in moral philosophy, explain their structure, and assess their respective problems and promises. This book offers all those interested in ethics, meta-ethics, or epistemology a more comprehensive understanding of transcendental arguments. It also provides them with new insights into uses of transcendental reasoning in moral philosophy.

Der Ausdruck ›Phänomenologie‹ steht für eine Reihe unterschiedlicher, teilweise einander kreuzender Denklinien innerhalb, aber auch außerhalb der Philosophie. So findet er sich z. B. auch in der klassischen Thermodynamik und der Thermodynamik irreversibler Prozesse, denen es um die Beschreibung von Zuständen physikalischer Systeme anhand von makroskopischen Messgrößen wie Druck, Volumen, Temperatur oder Dichte geht. In der Philosophiegeschichte und ihrem näheren Umfeld reicht der Gebrauch des Terminus von der Phänomenologie des Geistes über die phänomenologische Psychologie, die Phénoménologie de la Perception bis zur linguistic phenomenology.

Der Terminus ›Wohlfahrtsstaat‹ wurde von William Temple, Erzbischof von Canterbury, in den 1920er Jahren eingeführt, später von ihm als Gegenbegriff zum nationalsozialistischen »warfare state« verwendet und dominiert bis heute in der international vergleichenden Wohlfahrtsforschung, wird aber in öffentlichen Debatten wegen seiner negativen Konnotationen eines allumsorgenden und bevormundenden »nanny state« eher vermieden. In Deutschland herrschten nach 1945 der schon bei Lorenz von Stein in den 1870er Jahren zu findende Ausdruck ›Sozialstaat‹ und der Ausdruck ›soziale Marktwirtschaft‹ vor.

This volume presents the proceedings of the 3rd International Conference on Socratic Dialogue held in Loccum, Germany, in 2000, convened by the Philosophical-Political Academy, the Society of Socratic Facilitators, the Society for the Furtherance of Critical Philosophy and the Dutch Network of Socratic Facilitators. The proceedings focus on what Socratic Dialogue can contribute to ethical questions in different social fields. They range from philosophising with children to management consultancy and refer to projects and experiences with Socratic Dialogue in different countries demonstrating how to conduct ethical discourse on a global level.

Despite the exceptional growth of interest in the Capability Approach in specific fields of application, the approach has yet to clarify certain basic concepts, such as freedom, functioning, and, in particular, its key concept of capability. Taking two basic tenets of CA as my starting point, I would first of all like to contribute to the clarification of these central concepts. It thereby becomes apparent that “capability” is, on the one hand, an essentially hybrid concept with both an internal and external aspect. On the other hand, it addresses the freedom of choice between various lifestyles as a second-order competency. Against this background, this paper offers a suggestion to correct the terminology used by Martha C. Nussbaum in her concept of capability, and subsequently it will outline a basic model of the transformation of resources into forms of being and activities with reference to Ingrid Robeyns. In conclusion I will couple this rather static perspective with two critical points: First of all, a more dynamic view reveals hitherto barely considered aspects of freedom in everyday human lives. Secondly, the idea of capabilities opposes the attempt at a separation of capabilities from functions in order to avoid paternalism, as suggested by Nussbaum.

This essay is an account of the Socratic dialogue as a form of philosophical practice in an unusual setting, in prison. It conveys an overall picture of how in Tegel Penal Institution Socratic dialogue proceeds, and the kind of application for it in that setting. Among important aspects handled here are the characteristics through which Socratic dialogue demarcates itself from those customarily practiced techniques of psychological and therapeutic dialogue in prisons. The focus is on the question, whether any, and which kinds of, effects can be hoped for through Socratic dialogue in prisons

In der Rekonstruktion zentraler Gedanken beschranke ich mich auf die Philosophie des Organischen. Zunachst fuhre ich in Jonas' Stufenfolge des organischen Lebens und die "hochste" Stufe--d.i. seine Bestimmung des Menschen--ein und erganze diese Bestimmung; sodann rekapituliere ich seine Lesart der Stufen des Organischen uber die Stufe des einfachen Organismus bis zum hochentwickelten Tier unter Einbeziehung von moglichen naturwissenschaftlichen Einwanden. Endlich erortere ich Jonas' phanomenologisches Verstehen der Evolution "vom Hochsten aus" und konfrontiere es mit einer evolutionstheoretischen "Erklarung von unten" am Beispiel einer evolutionstheoretischen Erklarung "von unten", die Wolf Singer in seiner neurophysiologisch-evolutionistischen Erklarung des menschlichen "Bewusstseins" aus Elementen, Strukturen und Funktionen des Gehirns vorgeschlagen hat. Das Selbstverständnis des demokratischen Rechtsstaates ist durch ein facettenreiches Spannungsverhältnis von Moral und Recht geprägt. So bindet etwa das Grundgesetz mit der Verpflichtung zur Achtung und zum Schutz der Würde des Menschen wie auch mit dem Bekenntnis zu”unverletzlichen und unveräußerlichen“Menschenrechten alles staatliche Handeln an zentrale Postulate einer universalistischen Moral. Wenn Menschenwürde keiner noch so mehrheitlichen Meinung zur Disposition stehen dürfen, müssen sie dem politischen Streit entzogen sein. Diesem konstitutionalistischen Verständnis des Rechtsstaates scheint ein radikaldemokratisches Modell der Republik entgegenzustehen, nach dem eine politisch autonome Gesellschaft allein vermittels Gesetzen auf sich einwirkt, die aus Verfahren chancengleicher Teilnahme an politischer Willensbildung hervorgehen. Nach diesem Modell kann es keine außerpolitische Quelle rechtlicher Legitimität geben. Doch was bedeutet es für den Legitimitätsanspruch des demokratischen Rechtsstaates, wenn er gar nicht allen von der Herrschaft : etroffenen9 jene Rechte gleichumfänglich gewähren kann, die politische Autonomie konstituieren? Wie verträgt sich der idealisierte Gedanke einer vollständig inklusiven politischen Selbstbestimmung mit dem faktisch unausweichlichen Umstand, dass die Mehrheit der Rechtsadressaten immer einer Minderheit von Autoren gegenübersteht? Muss nicht jede realistische demokratische Lösung des juridischen Legitimationsproblems hinter dem kategorischen Anspruch zurückbleiben, den unverzagte Moraltheoretiker im Anschluss an Kant für das Menschenrecht reklamieren? Welche normative Rolle spielt dann der Begriff der Menschenwürde im diskurspragmatisch entschlüsselten Spannungsfeld von Moral und demokratisch erzeugtem Recht?
