On a standard interpretation, the aim of the formula of universal law is to provide a decision procedure for determining the deontic status of actions. By contrast, this chapter argues for the practical significance of the CI centering on Kant’s account of the dynamics of incentives. This approach avoids some widespread misconceptions about how the CI operates and false expectations about what it promises and delivers. In particular, it explains how it differs from deductive practical inferences. The CI is the supreme form of morality, and yet not in the sense that particular categorical principles can be derived deductively from it, once the relevant details are supplied. The efficacy of practical reasoning primarily concerns agents, and consists in their reorientation toward the right end. Moral knowledge is knowledge about what we ought to do, but it is also a distinctive variety of self-knowledge, that is, knowledge of ourselves as rationally efficacious agents.

Traditionally, philosophers have focused on whether and how emotions threaten autonomy, insofar as they lie outside the sphere of rational agency. That is, they have conceptualized emotional vulnerability as passivity. Second, they have considered how emotions are insensitive to rational judgment, focusing on cases in which emotions are dissonant or recalcitrant. Third, in recognizing the motivational force of emotions, philosophers have tracked their negative impact on rational deliberation. Indeed, emotions are often contrastive elements in rational deliberation. They appear to defeat deliberative judgments about what to do, survive rational deliberation or preempt the very possibility of rational deliberation. But there are more interesting cases in which it is apparent that emotions bear a rather complicated relation to autonomy. Love and shame provide powerful examples of the ambivalences and complexities of such a relation. In analyzing such complexities, my aim is to present a case for appreciating various dimensions of vulnerability and, correspondingly, for exposing the importance of emotional vulnerability for agential autonomy. This view is rooted in a general account of agential autonomy marked by mutual respect and recognition of others, as a normative response to constitutive vulnerability, understood as the capacity to affect and be affected by others as well as by external agentive and non-agentive causes.

This chapter discusses butō dance as an example of improvisation that challenges not only the extant philosophical definitions of improvisation, but also some fundamental presumptions about self-government and agency that are current in action theory. In the first part of the chapter, I identify the main features of butō improvisation, with regard to the nature of its basic movement, and the kind of subjectivity implicated in its generation. I then raise some questions regarding the philosophical characterization of this form of dance, and in the second part of the paper, I argue that butō improvisation undermines the intuitive distinctions between “ordinary” and “specialized action”, thereby eluding both the philosophical rationalistic theories of action as mediated by intentions, and the theories of arational action as expressive of individual subjectivity. My claim is that butō can be better interpreted as a shared action which is neither mediated by intentions nor expressive of the individual self, meant to generate a community by sharing the experience of the living body. This characterization has the advantage that it helps to put in the right perspective the puzzle about the normative standards of improvised action, which is addressed in the third part of the chapter. According to Nelson Goodman, improvisation as such undermines the very idea of a normative paradigm against which to evaluate possible solutions. In the case of butō, the absence of normative standards of action (e.g., success, correctness, or rightness) may be also connected to the absence of a subject in charge of his action. This is because butō improvisation does not count on the dancer as a pre-defined subject existing prior to and independently of her performance. In contrast to these interpretations, I hold that there are normative criteria for butō improvisation, which govern its explorative and generative functions by a training based on unselfing. This model turns away from the rhetoric of spontaneous free movements and the search for individual authenticity. It advocates for a model of intentional agency that it is not mediated by (individual or joint) intentions, but aspires to generate a community by sharing the experience of a living emotional body.

According to a traditional account, moral cognition is an achievement gained over time by sharing a practice under the guidance and the example of the wise, in analogy with craft and apprenticeship. This model captures an important feature of practical reason, that is, its incompleteness, and highlights our dependence on others in obtaining moral knowledge, coherently with the socially extended mind agenda and recent findings in empirical psychology. However, insofar as it accords to exemplars’ decisive authority to determine the standard of correctness for moral cognition, the model does not offer protection against arbitrariness and discrimination. The article argues that to understand the socially distributed nature of practical knowledge, we have to discard the notion of exemplars and reconceive of others as having equal normative standing. This claim allows us to revisit the conception of autonomy as key to distributed practical knowledge. While autonomy does not amount to selfsufficiency and self-reliance, it does demand independence of judgement and stands in contrast to servility, submission, and other sorts of defective ways of relying on others. The requirement of equal standing provides the basis for distinguishing between proper and improper reliance on others. Metaethical constructivism is the view that insofar as there are normative truths, they are not fixed by normative facts that are independent of what rational agents would agree to under some specified conditions of choice. The appeal of this view lies in the promise to explain how normative truths are objective and independent of our actual judgments, while also binding and authoritative for us. Constructivism comes in several varieties, some of which claim a place within metaethics while others claim no place within it at all. In fact, constructivism is sometimes defended as a normative theory about the justification of moral principles. Normative constructivism is the view that the moral principles we ought to accept are the ones that agents would agree to or endorse were they to engage in a hypothetical or idealized process of rational deliberation. Metaethical constructivist theories aim to account for the nature of normative truths and practical reasons. They bear a problematic relation to traditional classifications of metaethical theories. In particular, there are disagreements about how to situate constructivism in the realism/antirealism debate. These disagreements are rooted in further differences about the definition of metaethics, the relation between normative and metaethical claims, and the purported methods pertinent and specific to metaethical inquiry. The question of how to classify metaethical constructivism will be addressed in what follows by focusing on the distinctive questions that constructivist theories have been designed to answer. Section 1 explains the origin and motivation of constructivism. Sections 2–4 examine the main varieties of metaethical constructivism. Section 5 illustrates related constructivist views, some of which are not proposed as metaethical accounts of all normative truths, but only of moral truths. Sections 6 and 7 review several debates about the problems, promise and prospects of metaethical constructivism.

This chapter argues that some paradigmatic cases of collective action, called mass-action, build upon alienation. Individual alienation qualifies as a coordinative mechanism, which explains collective actions performed by large groups. Alienation requires individuals to detach from their personal stance, and bracket their personal attachments and motivations. Differently from strategic and normative coordinative devices, alienation bypasses strategic normative regulations, such as law and enforcement. However, individuals retain moral responsibility for mass action, which are aligned to delegated actions.

ValuingValuing is an important and ordinary endeavor, which pervades all our practices, activities, and institutions. The nature and criteria for valuing decisively depend on the alleged nature of values. First of all, are there values? If so, how to access them, and how do they inform our choices? Second, what kinds of value are there, and how do we identify them conceptually? Sections 1–2 identify these problems, which are the core of debates in meta-ethics and substantive theory, respectively. The criteria for judging the adequacy of a theory ofValuetheory of value including the capacity for explaining phenomena, and the normative capacity to guide action, are highlighted in Sect. 3. Theories of values offer large varieties of answers to these questions, as we shall see in Sect. 4. Such theories are also supposed to account for phenomena such as the possibility of ineradicable disagreements of valueValuedisagreement, and explain their implications, which are addressed in Sect. 5. Some disagreements seem to depend on the incommensurabilityIncommensurability of valueValueincommensurability, which can be defined in different ways. The implications of such claim are examined in Sect. 6. In Sect. 7, we consider whether and how the incommensurability of values affects the rationality of choice. Section 8 deals with some crucial receptive modalities of relating to values: the emotionsEmotion. Section 9 concerns personsPerson as both bearers and sources of value. Finally, in Sect. 10, we consider various modes of valuing.

This handbook offers a deep analysis of the main forms of legal reasoning and argumentation from both a logical-philosophical and legal perspective. These forms are covered in an exhaustive and critical fashion, and the handbook accordingly divides in three parts: the first one introduces and discusses the basic concepts of practical reasoning. The second one discusses the main general forms of reasoning and argumentation relevant for legal discourse. The third one looks at their application in law as well as at the different areas of legal reasoning. The handbook’s division in three parts reflects its conceptual architecture, since legal reasoning and argumentation are considered in relation to the more general types of reasoning.

This article argues that Rawls’ history of ethics importantly contributes to the advancement of ethical theory, in that it correctly situates Kantian constructivism as an alternative to both sentimentalism and rational Intuitionism, and calls attention to the standards of objectivity in ethics. The author shows that by suggesting that both Intuitionist and Humean doctrines face the charge of heteronomy, Rawls appearsto adopt a Kantian conception of practical reason. Furthermore, Rawls follows Kant in assuming that ethical objectivity can be vindicated only if the productive and constructive powers of reason are acknowledged. The author accounts for this assumption against the background of Kant’s moral psychology, and examines Intuitionist and Humean rejoinders. Contrary to a common view, the author arguesthat because of its claims on the nature of moral agency and the sovereignty of practical reason, Kantian Constructivism sets the standards of ethical objectivity higher than its alternatives, and is more ambitious and more demanding than the realist conception of objectivity.

Some philosophers object that Kant's respect cannot express mutual recognition because it is an attitude owed to persons in virtue of an abstract notion of autonomy and invite us to integrate the vocabulary of respect with other persons-concepts or to replace it with a social conception of recognition. This paper argues for a dialogical interpretation of respect as the key-mode of recognition of membership in the moral community. This interpretation highlights the relational and practical nature of respect, and accounts for its governing role over other persons-regarding concepts

In symmetrical moral dilemmas, the agent faces a choice between two incompatible actions, which are equally justified on the basis of the same value. These cases are generally discounted as spurious or irrelevant on the assumption that, when there is no failure of commensurability, choice between symmetrical requirements is indifferent and can be determined by randomization. Alternatively, this article argues that the appeal to randomization allows the agent to overcome a deliberative impasse, but it does not really resolve the moral dilemma. This is because randomization fails to provide the agent with a genuine reason for action. The argument is based on an account of arbitrariness as a threat to the agent’s authorship on action. By focusing on lack of authorship, rather than on failure of commensurability, we gain the adequate perspective to assess the philosophical significance of moral dilemmas, their impact on the agential integrity, and their consequences for ethical theory.
