Specters, Inc.: The Elusive Basis of the Corporation
    Business and Society Review 117 (4): 413-441. 2012.
In this article we discuss the political and economic consequences of the contemporary legal theory of incorporation. We argue that incorporation has developed historically in a way that makes it internally inconsistent, but that this inconsistency is useful for the powerful because of its legal and economic effects. The corporation can “shape shift,” which is very helpful for claiming some rights and disavowing certain responsibilities. Of course this flexibility comes at the expense of consist…Read more
In this article we discuss the political and economic consequences of the contemporary legal theory of incorporation. We argue that incorporation has developed historically in a way that makes it internally inconsistent, but that this inconsistency is useful for the powerful because of its legal and economic effects. The corporation can “shape shift,” which is very helpful for claiming some rights and disavowing certain responsibilities. Of course this flexibility comes at the expense of consistent concepts and this leads to the creation of what we term an “ideal‐type reified singular representation.” We go on to show the far‐reaching effects of this representation for legal studies, economics, and political theory, and show it worked in the pro‐corporate decision in the recent Citizens United case. We conclude by providing several alternative ways to think about the nature of corporate organization.

A Cognitive Model of Dynamic Cooperation With Varied Interdependency Information
with Cleotilde Gonzalez, Noam Ben-Asher, and Varun Dutt
    Cognitive Science 39 (3): 457-495. 2015.
We analyze the dynamics of repeated interaction of two players in the Prisoner's Dilemma under various levels of interdependency information and propose an instance-based learning cognitive model to explain how cooperation emerges over time. Six hypotheses are tested regarding how a player accounts for an opponent's outcomes: the selfish hypothesis suggests ignoring information about the opponent and utilizing only the player's own outcomes; the extreme fairness hypothesis weighs the player's ow…Read more
We analyze the dynamics of repeated interaction of two players in the Prisoner's Dilemma under various levels of interdependency information and propose an instance-based learning cognitive model to explain how cooperation emerges over time. Six hypotheses are tested regarding how a player accounts for an opponent's outcomes: the selfish hypothesis suggests ignoring information about the opponent and utilizing only the player's own outcomes; the extreme fairness hypothesis weighs the player's own and the opponent's outcomes equally; the moderate fairness hypothesis weighs the opponent's outcomes less than the player's own outcomes to various extents; the linear increasing hypothesis increasingly weighs the opponent's outcomes at a constant rate with repeated interactions; the hyperbolic discounting hypothesis increasingly and nonlinearly weighs the opponent's outcomes over time; and the dynamic expectations hypothesis dynamically adjusts the weight a player gives to the opponent's outcomes, according to the gap between the expected and the actual outcomes in each interaction. When players lack explicit feedback about their opponent's choices and outcomes, results are consistent with the selfish hypothesis; however, when this information is made explicit, the best predictions result from the dynamic expectations hypothesis

Of Butterflies and Masks: the Transfigurations of Apollo in Nietzsche's Early to Later Writings
    with Douglas Burnham
In Andrea Rehberg (ed.), Nietzsche and Phenomenology, Cambridge Scholars. pp. 33-52. 2011.
Nietzsche's early work on culture and tragedy proved influential on subsequent art and aesthetics; the relation between the Apollonian and Dionysian is central to this work. However, that relation is widely misunderstood, especially in its connection to Nietzsche's conceptions of Socrates and modernity. This paper contributes to the rectification of misunderstandings by demonstrating the proper way of understanding these relations. The analysis proceeds by way of a phenomenological treatment of …Read more
Nietzsche's early work on culture and tragedy proved influential on subsequent art and aesthetics; the relation between the Apollonian and Dionysian is central to this work. However, that relation is widely misunderstood, especially in its connection to Nietzsche's conceptions of Socrates and modernity. This paper contributes to the rectification of misunderstandings by demonstrating the proper way of understanding these relations. The analysis proceeds by way of a phenomenological treatment of the distinctive structure of the Apollonian. The analysis is reinforced by showing how Nietzsche's later work on the nature of cultural production and change reflects and depends upon it.

    Negotiating Values: Narrative and Exposition
    Journal of Bioethical Inquiry 5 (1): 41-55. 2008.
In this paper I focus on the limits of narrative by asking what kinds of things narratives do, and what kinds of texts do related things in other ways. In particular I focus on how narrative genres organise time in relation to value, drawing on functional linguistic models of temporality and evaluation. From a linguistic perspective, the various narrative genres negotiate different kinds of solidarity with listeners, and so the limits of narrative materialise various possibilities for communing …Read more

In particular I focus on how narrative genres organise time in relation to value, drawing on functional linguistic models of temporality and evaluation. From a linguistic perspective, the various narrative genres negotiate different kinds of solidarity with listeners, and so the limits of narrative materialise various possibilities for communing in a culture, alongside the potentialities for construing community through related and other genres of discourse—since in general, the limits/possibilities of our language (and attendant modalities of communication) are the limits/possibilities of our social world.
