No constitucionalismo contemporâneo ou neoconstitucionalismo os princípios constitucionais acolhem, normativamente, os principais valores e opções morais e políticas da comunidade. Os direitos fundamentais, muitas vezes são erigidos sob a forma de princípios normativos, que por sua vez encontram abrigo nos Textos Constitucionais atuais. A compreensão mais extensa de Dworkin sobre o que é o Direito, em uma perspectiva interpretativa, não se explica e nem se compreende sob a visão do positivismo jurídico. Não é despiciendo lembrar que um dos pressupostos metodológicos que acode a toda a doutrina positivista é a separação entre Direito e Moral. Assim, a compreensão dos princípios normativos, com a sua potencial recorrência a valores e opções políticas fundamentais, quebra esta suposta separação, ainda mais quando se encontram estes princípios em uma Constituição que se estabelece no centro de importância e significado de toda a ordem jurídica, irradiando os seus princípios constitucionais na compreensão e interpretação do sistema jurídico e consequentemente, rematerializando e ressubstancializando todo o Direito. Portanto, na perspectiva mais extensa do Direito, ressignificada pelo neoconstitucionalismo, uma Constituição que não abrigue direitos humanos fundamentais, sob a forma de princípios normativos e em caráter emancipatório, não pode ser reconhecida como uma verdadeira Constituição. É o que se pretende refletir e demonstrar no presente artigo, com o emprego de pesquisa bibliográfica em autores autorizados sobre o tema.

Classical models of decision making deal fairly well with uncertainty, where settings are well-structured in terms of goals, alternatives, and consequences. Conversely, the typical ill-structured nature of strategy choices remains a challenge for extant models. Such cases can hardly build on the past, and their novelty makes the prediction of consequences a very difficult and poorly robust task. The weakness of the classical expected utility model in representing such problems has not been adequately solved by recent extensions. In this paper we offer an explanatory coherence model for decision making in ill-structured problems. We model alternatives as sets of concurrent causal explanations of reality that act as justifications for action. According to these premises, choice is based on an evaluation of the internal coherence and the consistency of competing explanations of the available evidence. This model is psychologically grounded on causal inference and builds on the connectionist tradition of explanatory coherence. To illustrate the model, we consider the decision of investing in a new technology and we discuss how changes in the structure of alternatives may impact on the solution. We show how the final choice depends on collecting the relevant evidence, making the suitable hypotheses, and drawing the consistent causal explanations linking the two.

On reviewing the literature regarding acceptance and trust in human-robot interaction (HRI), there are a number of open questions that needed to be addressed in order to establish effective collaborations between humans and robots in real-world applications. In particular, we identified four principal open areas that should be investigated to create guidelines for the successful deployment of robots in the wild. These areas are focused on: (1) the robot’s abilities and limitations; in particular when it makes errors with different severity of consequences, (2) individual differences, (3) the dynamics of human-robot trust, and (4) the interaction between humans and robots over time. In this paper, we present two very similar studies, one with a virtual robot with human-like abilities, and one with a Care-O-bot 4 robot. In the first study, we create an immersive narrative using an interactive storyboard to collect responses of 154 participants. In the second study, 6 participants had repeated interactions over three weeks with a physical robot. We summarise and discuss the findings of our investigations of the effects of robots’ errors on people’s trust in robots for designing mechanisms that allow robots to recover from a breach of trust. In particular, we observed that robots’ errors had greater impact on people’s trust in the robot when the errors were made at the beginning of the interaction and had severe consequences. Our results also provided insights on how these errors vary according to the individuals’ personalities, expectations and previous experiences.

Although the influence of social support in health is a widely acknowledged factor, there is a significant gap in the understanding of its role on cognition. The purpose of this systematic review was, therefore, to determine the state-of-the-art on the literature testing the association between social support and cognition. Using six databases, we identified 22 articles published between 1999 and 2019 involving an empirical quantitative focus which meet the inclusion criteria. Data extraction was performed following PRISMA recommendations. To summarize the extracted data, we used a narrative synthesis approach. Despite limitations, there is overall preliminary evidence of a relevant positive association between social support and cognition. Our results demonstrate there is enough information for an outbreak of experimental research in the area and an expansion of this body of knowledge. We argue that the present evidence lays the foundations for a more comprehensive theoretical model, one that corresponds with the complexity of the topic and possibly considers models derived from social interaction and active inference theories.

As Hardie (1993, xi) has shown, Virgil's successors were all sharp and informed readers of the Aeneid, and their epic works should be read and interpreted as a creative rewriting and continuation, at once respectful and at times rebellious, of the Aeneid. Following this line of interpretation, I will argue that Lucan's Pharsalia, the so-called anti-Aeneid, 4 presents itself in the journey of Pompey as a critical, almost antiphrastic revisitation of Aeneas' journey. 5 The stages of Pompey's journey retrace some crucial stages of Aeneas' in the Aeneid, both [End Page 572] thematically and geographically. But Pompey's journey is "reversed"; it is turned "upside down." 6 It moves symmetrically backward, bringing the journey of the Aeneid back to its point of departure: from the West back to the East, from Rome back to Troy.In a comprehensive work on Lucan's Pharsalia, Ahl points out that among the many characters of the Pharsalia, Pompey is the one most closely modeled on Aeneas. 7 The first appearance of Pompey in the poem is symptomatic. At the beginning of the Pharsalia, Pompey is compared to an oak tree (like Aeneas in Aeneid 4). 8 But unlike Aeneas' firmly rooted mature tree, Pompey's tree is decayed and rootless. 9 Aeneas' roots are established in the very bowels of the earth, unshakable and immovable, and allow him to withstand the storm (Aen. 4.445- 46, ipsa haeret scopulis et quantum uertice ad auras / aetherias...

This introduction to this special section of Theory, Culture & Society focuses on the formation of power that Michel Foucault – in a number of texts and lectures from the late 1970s and early 1980s – analyzed under the label of ‘the pastorate’. Stressing the ongoing socio-political relevance of pastoral power, the article outlines some of the ways in which it continues to directly influence and animate an array of secular governmental techniques in manners that other critical paradigms can only partially account for. In this, it takes as its focal point two interrelated problematiques : (1) the relation between truth and subjectivity as a constitutive element of modern power relations and (2) the theological subtexts of modern governmentality – demonstrating how they are elaborated upon by the articles comprising the special section.

This study was used to evaluate whether the proximity of dogs to their human companions during sleep is associated with common problematic behaviors in canines, such as destroying objects, vocalizing excessively, urinating/defecating in inappropriate places (all when dogs are alone at home), and aggressive threats (growling or barking) and acts (biting) toward people. Over 60,000 dog keepers answered an online questionnaire that addressed where their dogs slept at night and the frequency with which they exhibited such behaviors. Except urinating/defecating in inappropriate places and biting people, other problematic behaviors were less frequent in dogs who slept inside the house. We conclude that dogs sleeping indoors (that is, closer to their keepers) less frequently exhibit aggressive threats and problematic behaviors that are commonly associated with separation anxiety.

This study investigated how keepers report correcting their dogs’ undesired behaviors by using what they consider to be aversive to them. Over 60,000 dog keepers responded to an online questionnaire addressing this issue. The questionnaire included the frequencies of delayed corrections of perceived signs of previously occurring undesired behaviors, the type of aversive actions applied (independently of correction timing), and the frequencies of specific canine behaviors that the keepers sought to correct. Based on results, correcting undesired behaviors of dogs that occurred some time ago is frequently reported, and the most common corrections are not necessarily effective in reducing these undesired behaviors. Moreover, keepers commonly use aversive actions to correct dogs’ urination/defecation in inappropriate places or destruction of objects, but they do not commonly do so for excessive barking or incorrectly responding to a cue.

Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed.

Building and expanding on Peter Sloterdijk’s work, in this essay I explore the interrelation between anthropotechnics qua practice of the self and the political sphere, with a view, in particular, to providing a genealogy of some of its recent developments. I first analyse the birth of anthropotechnics within the framework of the axial revolution (Karl Jaspers), as withdrawal and return to a common world bereft of certainty and self-evidence (section 2). Next, I show how the rise of asceticism shaped some of the central problematiques of classical politics and, in particular, political agonism and metaphysics, the latter here understood as a geometrical theory of political order (section 3). Against this background, I discuss how modern anthropotechniques have altered the classical relation between individual askesis and collective security, and how this, in turn, has paved the way for a certain understanding of self-mobilisation to saturate the government of the self in the twenty-first century (section 4).

This study examines the strategies developed by Italian Community Supported Agriculture (CSA) initiatives to de-commodify, de-instrumentalise and de-monetise labour in their attempt to prefigure alternatives to dominant capitalist agri-food systems. To do so we answer the following research questions: What type of strategies do these CSA initiatives employ to that end? What insights can be gained as regards the potential and barriers to fuller and more accomplished post-capitalist labour management within CSA initiatives? Data were collected through a participatory action research project involving 16 Italian CSAs, participant observation in meetings of CSA initiatives and the Italian CSA Network, and official documents collection. Across the three crucial moments considered in this study, we observe substantial difficulties in realising post-capitalist labour management as the initiatives are constrained by external requirements (e.g., legislation) and also internally by members’ weakness in implementing the CSA model due to their remaining integrated in the capitalist system. These findings point to the importance for CSA initiatives of deepening the collective process of deliberate deconstruction of valuation logics and predefined roles, as well as legal frameworks to find ways to enable the realisation of post-capitalist labour management. In this regard, we also suggest that the Italian CSA Network could play a more active role in addressing some of the internal and external factors hindering the consolidation of CSA initiatives and the manifestation of their transformative role.
