6Hegel on Crime and PunishmentIn Thom Brooks Sebastian Stein (ed.), Hegel's Political Philosophy: On the Normative Significance of Method and System, Oxford University Press. pp. 202-221. 2017.This chapter offers a _systematic reading_ of Hegel’s comments about punishment in his philosophical system with careful attention to his _Philosophy of Right_. It argues that the conventional reading, which claims his theory of punishment is mostly confined to the section Abstract Right, raises interpretive difficulties. One problem is the inadequacy of punishment as described in Abstract Right to be a complete theory of punishment. A second problem is accounting for apparent inconsistencies be…Read more

85Rawls's Political Liberalism (edited book)Columbia University Press. 2015.Widely hailed as one of the most significant works in modern political philosophy, John Rawls's _Political Liberalism_ defended a powerful vision of society that respects reasonable ways of life, both religious and secular. These core values have never been more critical as anxiety grows over political and religious difference and new restrictions are placed on peaceful protest and individual expression. This anthology of original essays suggests new, groundbreaking applications of Rawls's work …Read more

Each focuses with different elements of my work. Antony Duff examines the definition of punishment in my first few pages. Michelle Madden Dempsey analyses the importance given to coherence in my account and critique of expressivist theories of punishment. Richard Lippke considers my statements about negative retributivism in an important new defence of that approach. I examine each of these in turn …Read more

121A Précis of PunishmentPhilosophy and Public Issues - Filosofia E Questioni Pubbliche 5 (1). 2015.Punishment is a topic of increasing importance for citizens and policy-makers. The same can be said for academic researchers and students. Mass imprisonment has reached record high levels while public confidence is often lacking. New thinking is required urgently to address these challenges. Moreover, there have been several key developments in the philosophy of punishment over the last 20 years absent in leading guides including the communicative theory of punishment, restorative justice and my…Read more

34Testing CitizenshipPhilosophy Compass 20 (8). 2025.Discussions about citizenship routinely overlook the increasingly regular use of citizenship tests in practice. This essay critically surveys why citizenship tests have arisen and the different models that are in use. It is argued that those seeking to examine citizenship should not ignore the use of tests whether or not any specific model is defended. Moreover, addressing the issue of testing citizenship raises important philosophical issues that should be examined.

47Restorative Justice and Punitive RestorationIn Molly Gardner & Michael Weber (eds.), The Ethics of Policing and Imprisonment, Springer Verlag. pp. 129-150. 2018.Restorative justice approaches offer a promising alternative to formal sentencing. Victims are more satisfied, reoffending is less and at reduced costs. However, these findings are limited in scale and application that confine these approaches to relatively few cases that restrict their potential. I argue for a fundamental revision called punitive restoration that permits otherwise forbidden options like hard treatment. Punitive restoration can justify their use where they can best enable the re…Read more

110A Critique of Von Hirsch's Censure TheoryRatio Juris 38 (1): 5-20. 2025.Andreas von Hirsch's desert-based censure theory defends an influential penal theory centred on blame and proportionality. This article critically examines this theory and identifies three key problems relating to its justification of punishment and its distribution. The article argues that not all of these problems are resolvable, raising serious concerns about the tenability of censure theory in sentencing policy without significant modifications.

113Republican ChildrenPhilosophy and Public Affairs 53 (1): 37-65. 2025.Parents appear to dominate their children in ways they cannot with other adults. While it might seem unavoidable, this issue raises important questions about whether children are unfree under parental authority. Republican theories of freedom, such as Philip Pettit’s influential account, look especially vulnerable. He claims that we are free only if non-dominated and so not under the arbitrary interference by others. Domination is a threat to freedom that republican freedom opposes for all. Howe…Read more

24Political philosophy: the fundamentalsWiley. 2025.Just about everyone sees freedom, or liberty, as having huge importance. After all, our freedoms are a foundation that political authority is built on. But if you ask what freedom is, there can be very different answers about how it is defined. So, what is freedom? When can we said to be free or unfree? Is freedom about having options or achieving goals? How, if at all, can we justify limits on freedom? This chapter discusses these questions. We will begin by considering the foundational issue o…Read more

76Hegel and the Unified Theory of PunishmentIn Hegel's Philosophy of Right, Wiley-blackwell. 2011.G. W. F. Hegel’s theory of punishment has been most often thought to fit within a particular penal camp. The most popular interpretation is that this theory is retributivist because criminals should only be punished only where deserved in an effort to “annul” crime. Others believe this theory is a theory of moral education whereby criminals come to understand their crimes as wrongs in an effort to reform their behaviour. These interpretations all fail to acknowledge the novelty of Hegel’s theory…Read more
