Selon la perspective « politique » ou « pratique », les droits humains sont des revendications que les individus entretiennent face à un certain nombre de structures institutionnelles, dans certains États modernes, en vertu des intérêts qui sont les leurs selon les contextes qui les mettent en jeu. Selon la perspective « humaniste » ou « naturaliste », plus traditionnelle, les droits humains sont des revendications pré-institutionnelles que les individus entretiennent face à tous les autres individus, en vertu d’intérêts propres à l’humanité qu’ils ont tous en partage. Cet article soutient qu’une fois qu’on identifie ces deux perspectives sous leur meilleur jour, on peut voir qu’elles sont complémentaires et qu’on a en réalité besoin de chacune d’elles pour donner sens, sur le plan normatif, à la pratique contemporaine des droits humains. J’y explique comment des considérations humanistes et politiques peuvent et même doivent travailler main dans la main si on veut rendre compte du concept, du contenu et de la justification des droits humains. | : This essay explores the relation between two perspectives on the nature of human rights. According to the « political » or « practical » perspective, human rights are claims that individuals have against certain institutional structures, in particular modern states, in virtue of interests they have in contexts that include them. According to the more traditional « humanist » or « naturalistic » perspective, human rights are pre-institutional claims that individuals have against all other individuals in virtue of interests characteristic of their com mon humanity. This essay argues that once we identify the two perspectives in their best light, we can see that they are complementary and that in fact we need both to make good normative sense of the contemporary practice of human rights. It explains how humanist and political considerations can and should work in tandem to account for the concept, content, and justification of human rights.

RésuméAu cœur de la théorie de Sophia Moreau sur la discrimination répréhensible réside le devoir moral de traiter les autres comme des êtres égaux. Cet essai soulève quelques questions sur les contours de ce devoir et suggère des moyens de renforcer la théorie. En particulier, il suggère d'intégrer une vision cosmopolite de la portée de ce devoir, d’éclairer les caractéristiques à la base du statut moral égal des personnes afin d'en identifier les fondements, ainsi que d'identifier certaines considérations relatives à des intérêts d'importance afin d'en préciser le contenu. La relation entre la théorie de Moreau et le discours sur les droits humains est également brièvement examinée, et une discussion plus approfondie de ce dernier est recommandée.

In this dissertation, I argue that we should reframe the presentation and defense of the program of discourse ethics and deliberative democracy (DEP) in such a way that we make clear its connection to the substantive moral ideas of solidarity, equality and freedom. This program basically says that we should, when we can, determine the validity of the norms regulating our social life through practices of public deliberation. If we want to understand why engaging in public deliberation makes moral sense, or is obligatory, we need to make explicit the connection between the formal procedures of deliberation and our most basic substantive moral ideas of freedom, equality and solidarity. In order to unpack this claim, I construct what I call an expressive-elaboration model of the relation between substance and procedure in public deliberation. According to this model, we should see the two dimensions as working in tandem, in such a way that deliberative procedures are understood as the medium of expression and elaboration of our basic substantive ideas of solidarity, equality and freedom. The three ideas are expressed in the fact and form of deliberation, and elaborated in their changing and specific interpretations as topics and consequences of deliberative practices. To develop this model, I start with a consideration of certain insights of Kant's moral theory, and proceed to bridge the gap between Habermas's more formalistic and Rawls's more substantive neo-Kantian accounts of practical reason. The result is a straightforwardly substantive articulation and defense of the dialogic procedures of DEP based on the recognition of the fact of widespread moral disagreement and a fundamental project of justice demanding that we deal with that condition of disagreement by constructing social arrangements in which we include each other, solidaristically, as free and equal members. This morally substantive defense of DEP referring to the fact of widespread moral disagreement and the fundamental project of justice is different from, and more compelling than, other common, formalistic and prudential defenses of DEP.
