El presente ensayo investiga la filosofia política de Rousseau bajo la perspectiva de la problemática del poder. El contrato social no se orienta por el primado moderno del "Gobierno", sino que concibe la constitución de la comunidad como un modo autónomo de poder que en condiciones democráticas alcanza su realización en la soberanía popular. La figura enigmática del legislador pone de manifiesto, aunque en forma restringida, una tercera forma de poder: la autoridad o el poder de acción en cuanto competencia de iniciativas políticas. El balance entre estos tres tipos de poder constituye el marco en que se inscribe la concepción moderna de la política.

In recent decades, the concept of „nation“ has received a rather sceptical resonance. Although highly successful in a historical sense, the modeling of the state in the shape of a nation seems to have become obsolete. The liberal tradition of political theory tends to cancel the nation-state in a global republic. The question, however, is not how to realize universal standards but rather what is an appropriate understanding of a political constitution, which is not only a set of abstract norms but also a constellation of powers. The decisive point is that power cannot be reduced to authority. Power refers, on the one hand, to the ability to act that manifests itself as competence in the social dimension, and on the other hand to the focus of the constituting power, the subject of integrative sovereignty. This analysis of political constitution enables us to understand the problem to which the very idea of the nation was the answer.

Die 4. Auflage bringt zunächst die Kommentierung der Präambel und der Art. 1 bis 19 auf den aktuellen Stand von Judikatur und Literatur. Die grundlegende Struktur des Kommentares wurde beibehalten und um neuere Entwicklungen wie die Implikationen der Europäisierung und Digitalisierung sowie der Corona-Pandemie ergänzt.Die Herausgeberschaft des Kommentares hat ab der 4. Auflage Frauke Brosius-Gersdorf übernommen. Auch im Autorenkreis sind personelle Veränderungen zu verzeichnen: Mit Ausnahme von Frauke Brosius-Gersdorf, Alexander Thiele und Ferdinand Wollenschläger, die bereits an der 3. Auflage mitgewirkt haben, liegen die Kommentierungen in den Händen neuer Autorinnen und Autoren.Der Kommentar erscheint in drei Bänden und wird nur geschlossen abgegeben.Der Grundgesetz-Kommentar ist Bestandteil des Moduls Verfassungsrecht PREMIUM, das bei beck-online.de erhältlich ist.

Despite his undeniable erudition Kondylis never made his mark on the contemporary discussions. This is not surprising, because he preferred to stay in opposition to the mainstream of normativistic thinking, as shown in a rereading of his programmatic work on “Macht und Entscheidung”. Yet this isolated position allows the deficits of normativism to be perceived in remarkable lucidity in mirror-image reversal: a restricted perception of political power and the unclear relation between deliberation and decision. Hence the consequence can be drawn that any attempt at a normative conception of life-world must clarify its relationship to a positive concept of power and the meaning of decision-making.
