The Value of Critique casts its gaze on the two dominant modes of passing judgment in art--critique and value. The act of critique has long held sway in the world of art theory but has recently been increasingly abandoned in favor of evaluation, which advocates alternate modes of judgment aimed at finding the intrinsic "value" of a given work rather than picking apart its intentions and relative success. This book's contributors explore the relationship between these two practices, finding that one cannot exist with the other. As soon as a critic decides an object is worthy enough of their interest and time to critique it, they have imbued that object with a certain value. Similarly, theories of value are typically marked by a critical impetus: as much as critique takes part in the construction of evaluations, bestowing something with value can then trigger critiques. Assembling essays from an international array of authors, this book is the first to put value, critique, and artistic labor in conversation with one another, making clear just how closely all three are related.

In the Critique of Judgment, Kant quotes the traditional view of the relation between the ethical and the aesthetical ('the beautiful is the symbol of the morally good'). However, he elaborates this view in a radically new way: as equivalence between two forms of reflection, between ethical and aesthetic reflection. The article distinguishes three different aspects of aesthetic reflection in Kant and discusses their respective ethical meaning. It shows the unresolved tension between Kant's program of an 'aesthetics of autonomy' on the one hand, and his reference to sensualistic and vitalist motifs of an aesthetic 'energetism' on the other

What makes a revolution possible? The text understands this as the question for the subject that is able to make a revolution. Any attempt to answer this question is faced with an aporia: The subject of the revolution can neither be identified with its historically produced social form, nor can it be the subject “as such,” as the power of negativity prior to history and society. The article suggests to find a way out of this aporia in the idea of a transcendental turn of subjectivity: The revolution is the transcendental usage of the subject’s historically acquired and socially formed capacities. The possibility of the revolution lies in the revolutionizing of possibilities.

“Life” has become an enigmatic keyword in diverse fields of contemporary philosophy in the past years – from political thought and its reflections on biopolitics to practical philosophy and its recourse to forms of life, to aesthetics and its reflections on the modes of life and liveliness in aesthetic representation. The contributions included in the following special section investigate the peculiar way this keyword functions in a diversity of fields, in order to bring to light the underlying conceptual and structural implications of this term in these different domains. As these contributions show, the use of the marker “life” is more than a fleeting fashion – it articulates a modern predicament with deep historical roots.

Systems theory and deconstruction alike conceive of modern law as self-reflective: Modern law entails in itself its own other; from this follows its paradoxical structure which is exemplified by the concept of legal person as a “two-sides-form” (Zwei-Seiten-Form: Luhmann) of “social person” and “concrete individuality”. Systems theory and deconstruction differ, however, in how they conceive of modern law’s paradoxical self-reflection: Systems theory grants it the power of form-constitution. This is shown by Luhmann’s interpretation of the figure of subjective right; in it, law’s paradoxical self-relation has become legal form. Deconstruction instead consists in unfolding the undecidable ambiguity in the relation between paradox and form: Modern law’s paradoxical self-reflection as much constitutes as dissolves legal form. This may be called the “paradox of paradox” of self-reflective law in which Derrida sees its essentially political character.

"Das Rechtssystem geht davon aus, dass der Mensch – und nur der Mensch – eine natürliche Person ist. Das sei ein Irrtum, argumentiert Malte-Christian Gruber, denn die Rechtssubjektivität wird keineswegs alleine mit dem bloßen Menschsein begründet. Es ist die sittliche Autonomie, die den Menschen zu einem »Subjekt, dessen Handlungen einer Zurechnung fähig sind« (Kant) und mithin zur Person macht. Personen werden nicht mit dem Menschsein als solchem identifiziert, sondern durch die Zuschreibung von Handlungs- und Rechtsträgerschaft. Eine solche funktionale Vorstellung von Rechtssubjektivität ist prinzipiell auch dazu imstande, neben Menschen noch weitere autonome Agenten als Träger von Rechten und Pflichten ein- zusetzen, z.B. technische Artefakte und andere nicht-menschliche Agenten. Christoph Menke macht dagegen darauf aufmerksam, dass die Erfindung neuer Rechte das eigentliche Bewegungsgesetz der politischen Emanzipation in der Moderne war. Das begann mit den bürgerlichen Revolutionen und ist immer noch das generelle Modell, mit dem Politik und Theorie operieren, die neue Rechte für nicht-menschliche Lebewesen und Artefakte einfordern. So wie im 19. und 20. Jahrhundert die rechtliche Emanzipation zunächst über die Grenzen bürgerlicher Subjektivität hinausgeführt hat und soziale und kulturelle Rechte erfand, so sollen wir nun den weiteren, konsequenten Schritt tun und auch noch die Bindung der juridischen Anerkennung an die Kategorie menschlicher Subjektivität aufbrechen. Auch Bio- und Artefakte sollen als eigenständige Rechtssubjekte rekonstruiert werden. Es fehlt ihnen allerdings etwas, das in den emanzipatorischen Kämpfen der Vergangenheit schlechthin grundlegend war: Ein Träger von Rechten zu sein, hieß, ein Fordernder von Rechten, ja, ein Kämpfer für Rechte gewesen zu sein. Man konnte keine rechtliche Person als Träger von Rechten sein, ohne ein politisches Subjekt als Kämpfer und Denker von Rechten gewesen zu sein. Wenn die Bindung der rechtlichen Personalität an die menschliche Subjektivität aufgelöst wird, damit es Bio- und Artefakt-Rechte geben kann, löst sich zugleich auch diese Einheit von rechtlicher Personalität und politischer Subjektivität auf, die die moderne Idee der Rechte definiert hatte. The legal system assumes that human beings – and only human beings – are natural persons. That is erroneous, argues Malte-Christian Gruber, because legal subjectivity isn’t founded in humanity alone. It is moral autonomy that makes man into a “subject whose actions are capable of attribution” (Kant) and thus into a person. Personhood is not identified with being human as such, but by the attribution of actions and legal ownership. Besides human beings, such a functional concept of legal subjectivity can in principle also be applied to other autonomous agents as holder of rights and obligations, e.g. techno- logical artifacts and other non-human agents. Christoph Menke in turn points out that the invention of new rights was the actual law of motion of political emancipation in modern times. This began with the bourgeois revolutions and is still the general model with which politics and theory operate to claim new rights for non-human creatures and artifacts. Just as in the 19th and 20th centuries, the legal emancipation initially led beyond the limits of bourgeois subjectivity and in- vented social and cultural rights, so should we make a further consequent step and break with the dependence of juridical recognition on the category of human subjectivity. Also bio- and artifacts are to be reconstructed as independent legal entities. However, they lack something that was absolutely fundamental in the emancipatory struggles of the past: to be a subject of rights meant to have demanded rights, indeed, to have been a fighter for rights. One could not be a legal person and holder of rights without having been a political subject as fighter and thinker of rights. To suspend the dependence of legal personhood on human subjectivity so that there may be bio- and artifact-rights also means to dissolve the unity between legal personality and political subjectivity that once defined the modern idea of rights. "

Das Konzept der Negation ist der zentrale Operator bei der Unterscheidung zwischen historischem Wandel und natürlicher Evolution, welche grundlegend für das moderne Denken ist. Die Krise dieser Abgrenzung ist somit auch eine »Krise der Negation« (AlainBadiou). Der vorliegende Text untersucht die Krise, indem er zuerst Hegels Konzept der »bestimmten Negation« und deren Auswirkungen auf das moderne Verständnis von Revolution beleuchtet und erörtert im Anschluss zwei mögliche Alternativen, wie Negation noch verstanden werden kann: als abstrakte Negation (Luhmann) und als endlose Negation (Agamben). The concept of negation is the central operator in distinguishing between historical change and natural evolution, which is constitutive of modern thinking. The crisis of this distinction is therefore the »crisis of negation « (Alain Badiou). The text examines this crisis by first considering Hegel’s concept of »determinate negation« and its impact on the modern understanding of revolution and then discusses two possible alternative understandings of negation: abstract negation (Luhmann) and infinite negation (Agamben)

En el proceso de revisión de Arendt no se trata únicamente sobre la conveniencia o inconveniencia del juicio sucedido en Jerusalén, sino del derecho en general frente a estos hechos; se trata nada menos que sobre una reflexión, o más precisamente de una autoreflexión del derecho; una reflexión sobre el derecho y sus límites o fronteras, pero, dentro del derecho. Al seguir la revisión del proceso en Jerusalén hasta esta auto-reflexión radical del derecho, Arendt se coloca así no sólo, como pareciera en un principio, en el lugar del tribunal sino por encima del tribunal más elevado. In Philosophy and Real Politics, Raymond Geuss outlines the program of a “realistic” investigation of politics and develops a critique of the normativistic approach that defines the mainstream of contemporary analytic political philosophy. The paper discusses the question of how these two elements, “realism” and “critique”, are related in Geuss. Drawing on some of Geuss′ considerations in Outside Ethics the paper argues that the very existence of “real politics” depends on the critique of those normativistic forms of thinking that threaten to dissolve the reality of politics. Hannah Arendt's 1949 essay on the critique of human rights was published in English and German in the same year under two quite different titles: while in English the title asks the skeptical question: "'The Rights of Man'. What Are They?", the German title claims: "Es gibt nur ein einziges Menschenrecht " - "there is only one human right". The article shows that the English title's skepticism and the German title's assertion represent two internally connected moves of Arendt's argument. For Arendt aims at a fundamental critique of the modern natural law tradition of human rights which, at the same time, hints at a possible alternative understanding of a " right to have rights" in terms of a political anthropology - a new understanding of human dignity.

It is a well-known fact that the term ‘subject’ acquired its still predominant meaning only as late as the mid-eighteenth century, and that this led to the formation of the term ‘subjectivity’ at the end of the century. In this recent or ‘modern’ use, the term ‘subject’ is no longer taken just in its grammatical meaning where a subject is that of which something can be predicated, but refers to anything that can say ‘I’. In this sense, the predicate ‘subjectivity’ is not coextensive with, but is confined to, the realm of human beings. There are human beings who are not yet or are no longer subjects, but there are no subjects who are not human beings. Only human beings have the capacity to say ‘I’. This describes the new meaning the term ‘subject’ gains at that moment in the eighteenth century, but it does not yet grasp why this new use of the term ‘subject’ marks the beginning of a new, ‘modern’ way of thinking. For that semantic shift of the word ‘subject’ does not of course mean that subjectivity, referring to the capacity to say ‘I’, was discovered only then and unknown before. Rather, the epochal significance of the new use of the term lies in the fact that—and the way in which—the reference to beings capable of saying ‘I’ is often mixed up in an opaque way with the indication of a quite different determination: namely the specifically modern determination of the subject of reflection. The modern emphasis refers to the subject as the instance or place of a process of reflection in which anything objectively existing or pregiven is dissolved. This is what makes the shift in our speaking of a ‘subject’, some time in eighteenth century philosophical discourse, into a decisive fact for our understanding of modernity: it connects the reference to I-saying beings with the emphasis on a new practice of reflection.
