This essay states in brief compass the argument developed at length in Transcendental Causality and the Intelligibility of the Real: The Second Way in the Light of Contemporary Science (Neunkirchen-Seelscheid, Editiones Scholasticae, 2026; ISBN 978-3-86838-320-1), and is posted here with the publisher's kind permission. Aquinas's Second Way is usually written off together with the arguments from a first beginning. Hume is said to have shown that causal inference lacks a priori warrant, Russell that nothing stops us from taking the universe as an ultimate fact. Both criticisms, however, tell against a version that is not the argument's own, the one that turns it into a search for the first temporal link. Read synchronically, the Way does not ask how the universe began. It asks what sustains, here and now, the existence and the operation of everything there is. Its two load-bearing joints are an existential premise, that the cosmos contains causal multiplicities essentially and actually subordinated (today better described as hierarchical networks than as chains) and a categorial premise, according to which no concatenation of derived sufficiencies, even an infinite one, yields intrinsic sufficiency. From these it follows that the existence of the first cause is independent of every global property of any cosmological model, so that eternity, cycles and the multiverse are strictly irrelevant to the proof. The principle of sufficient reason the argument employs survives Della Rocca's threat of modal collapse once a founding reason is distinguished from a determining one.

Después de analizar los documentos de la ONU y del Parlamento Europeo instando a los gobiernos para que no reduzcan las AOSs en su presupuesto, se constata que la actual crisis financiera se está cerrando en falso porque las medidas tomadas no están afrontando una reforma en profundidad del sistema de Bretton Woods, que desde 1973 estaba agotado ya que el anuncio de Nixon de la no convertibilidad del dólar en oro significó ontológicamente que el papel se había adueñado del sistema financiero. El incremento de las crisis bancarias desde entonces ha venido acompañado de una creciente complejidad, pero también inutilidad, de la arquitectura de control del sistema, por ser autorreferente. Al no haber atendido la recomendación keynesiana de Joseph Stiglitz de crear un sistema mundial de reservas, sólo cabe esperar una próxima crisis financiera que ponga en evidencia las cinco consecuencias filosóficas que se pueden sacar de esta crisis: (1) Que la ley de la oferta y la demanda es una ficción. (2) Que los mercados son irracionales. (3) Que el consenso de Washington conduce a un desastre ético mundial, porque el egoísmo no puede ser el valor organizador de la sociedad. (4) Que el dinero no refleja la economía real. Y (5) que el principio de incertidumbre no sólo rige en la mecánica cuántica, sino también en la economía.

Un repaso etimológico de los nexos terminológicos entre “realidad” y “mundo” permite concluir que la crítica de Kant, que niega Realität al Mundo como omnitudo realitatis, al tiempo que admite la existencia de la Wirkleichkeit de las cosas en este mundo por interfacticidad con los egos corpóreos que las experimentamos, determinan críticamente tanto las discusiones cosmológicas en el siglo XX (A. Einstein), como las categorizaciones fenomenológicas y existenciales de la filosofía actual (M. Heidegger). Para cuestionar la “realidad del mundo” es preciso mantener abiertos ambos frentes gnoseológicos. En filosofía no todo realismo tiene que ser materialista, pero los filósofos materialistas defienden el realismo de la experiencia común (G. Santayana). Sin embargo, el compromiso ontológico con el materialismo no es una mera consecuencia del realismo científico (M. Bunge). Más allá de las discusiones sobre la compatibilidad o incompatibilidad de la «teoría cuántica» y de la «teoría de la relatividad» y del fracaso final de Einstein (desigualdades de Bell, experimento de Aspect, etc.) que no pudo establecer una teoría de campos unificada, los físicos que recelan sobre las afirmaciones metafísicas acerca del mundo, porque no hacen afirmaciones sobre cosas en sí sino sobre las observaciones realizadas con sus órganos sensoriales y sus aparatos, acaban abrazando posiciones subjetivas, y/o fenomenistas en la línea de Hume y Kant. Ahora bien, al mismo tiempo, no tienen más remedio que considerar las fuerzas, las funciones o los campos que descubren, así como las posibles series causales que describen de la manera más exacta posible, como reflejos verdaderos (auténticos, reales) del «mundo en que vivimos». En el artículo se argumenta que el verdadero significado filosófico de la mecánica cuántica es que vino a cuestionar el «mundo real» de las experiencias cotidianas, en el que todavía parecía moverse la física clásica, produciendo (de rebote) una ruptura entre «realidad» y «mundo». O bien la «realidad» desbordaba el «mundo» (y entonces deberíamos reconocer la existencia de «realidades no mundanas») o bien la idea misma de un «mundo único» dejaba de ser unívoca (y entonces las ecuaciones cuánticas nos remiten a una «pluralidad de mundos», que, por un lado, son «mundos fantasma» porque sólo existen cuando no son observados, mientras por otro son «realidades virtuales», que sólo se actualizan cuando son observadas). Que la interpretación de Copenhague tropezase de bruces con la filosofía que el neopositivismo había retirado del escenario de la confrontación intelectual, no sólo derrumba el dogma de que «los límites del lenguaje eran los límites del mundo», sino que además obliga a los físicos cuánticos a decir cosas sobre aquello «de lo que no se puede hablar»: ¿Qué clase de «realidad» es esa que permanece cuando se desvanece el «mundo» en los límites inmensos del espacio-tiempo o en los bordes infinitesimales de la microfísica? Para el materialismo filosófico los desarrollos científicos de la física tienen significación filosófica, tanto gnoseológica como ontológicamente, no en razón de las interpretaciones, sino de las construcciones. El artículo concluye reiterando que ontológicamente el contenido semántico de la Idea de Materia no es la unidad, sino la multiplicidad. Este punto de acuerdo entre los materialistas se rompe cuando se pretende unificar la realidad bajo el paraguas trascendental de un Ego gnoseológico, que sólo aparece como un esquema de la racionalidad crítica exigido por la propia multiplicidad material para poder realizar el camino de vuelta, el progressus hacia las configuraciones de partida. Al darle existencia ontológica, como si se tratara de un polo unitario destinado a convertirse en la clave de bóveda del Mundo, caemos de nuevo en la tentación trascendental (incluso teológica) que pretendemos eludir.

La Teoría Comunicacional del Derecho se construye desde un posicionamiento ontológico débil, que pasa por afirmar que el Derecho es comunicación o, más precisamente, se manifiesta a través de un lenguaje propio y relativo a cada comunidad, cuya semántica ha de ser continuamente reelaborada por los juristas y pragmáticamente puesto en acción por los tribunales, con ocasión de cada nuevo suceso o conflicto. Este artículo intenta explicar sintéticamente cuáles son las tesis principales sobre las que se erige esta Teoría del Derecho y ofrecer una aproximación crítica a las mismas.

The Communicational Theory of Law (CTL) usually differentiates between Legal Sociology and Legal Theory, in the sense that Legal Sociology is concerned with the social validity of the rules and Legal Theory with the formal or legal validity of the rules. It can be argued that both disciplines are two different perspectives of the same empirical reality (legal rules). Also, legal System and social milieu are two closely linked realities; they cannot be separated because they need each other. The Law is the form or order that the social milieu takes, and, at the same time, the social environment provides the ideas, collective representations and other matters that need a legal regulation. For this reason, the epistemological separation between Sociology and Legal Theory must be overcome when the theoretical perspective comes to legal decisions. Thus, the decisional moment becomes the meeting point between the legal System and the social milieu. This is where the concept of the legal System fulfils its main function, as it allows for the dynamism and adaptability of the legal order. The hermeneutic re-elaboration of the normative texts will be the channel through which the social facts and other material elements can inform the meaning or possible interpretations of the rules and institutions of the legal order. This happens primarily by influencing theoretical and doctrinal works of an expository and didactic nature; and secondarily by influencing the decisions of legal operators and courts. This study seeks to explain how the social context influences legal decisions and the formation of the legal System, from a communicational perspective of Law. In order to do so, it will be necessary to set out two epistemological premises of CTL: the semiotic tripartition of the Theory of Law and the legal Order-legal System distinction.

Este artículo pretende mostrar la convivencia de dos estructuras de pensamiento en la escolástica española y, especialmente, en Suárez. Vitoria presenta una visión comunitaria del orden internacional y sus enseñanzas serán transmitidas a Suárez, quien, al contrario, presenta una visión societaria del orden internacional. Esta diferencia no es una casualidad, sino un auténtico cambio de paradigma en el sabio granadino, que hace de él un autor más próximo a la modernidad que a la tradición escolástica. Gracias a un estudio comparado mostraremos el punto de inflexión que supone Suárez en el tránsito hacia la modernidad y su idea de un orden mundial fundado en una sociedad de Estados.

This study aimed to analyze the levels of personal aggression and victimization, ethnic-cultural aggression and victimization, self-esteem, empathy, social skills and gender in adolescents as potential predictors of bullying in Spain and Ecuador. The wide pluricultural sample comprised Secondary Education students from both countries (N = 25190, average age = 13.92, SD = 1.306; NSpain = 14437; NEcuador = 10753), who took part in the study by filling in a self-report. The results revealed that predictive models of bullying for both countries explain 50-70% of variance. A transnational predictive pattern of personal victimization can be observed based on the levels of ethnic-cultural victimization, ethnic-cultural aggression, personal aggression, self-deprecation and affective empathy. A transnational predictive pattern of personal aggression is evidenced depending on the levels of ethnic-cultural aggression, personal victimization, self-deprecation, ethnic-cultural victimization and the fact of being female. We concluded that bullying can largely be predicted by involvement in ethnic-cultural discrimination. These results are discussed, and educational inferences are drawn for prevention.

In the late 1970s and early 1980s, Brazilian Bishop Pedro Casaldáliga wrote two liturgies of repentance: Missa da terra sem males, which expresses remorse and apology on behalf of the Roman Catholic Church addressed to the indigenous peoples of Brazil, and Missa dos Quilombos, which repents for the Church’s sins against the Afro-Brazilian community. These liturgies model a way to respond to the moral problems of the Church’s involvement in colonization and the slave trade, as well as its ongoing complicity with racial discrimination and abuse. If the Church wishes to be true to its moral commitments and to act as a relevant force in society, it must acknowledge its wrongdoings and redress the harms it has perpetrated.

The aim of this study is to characterize the weak discussion about the Human Rights in Franco’s time, not in general, but by testing Vallet de Goytisolo’s works. This author is deeply influenced by the lectures of M. Villey, Parisinian philosopher well-known by his denial of Human Rights. A comparative study of these authors will be done focusing on two - faced aspects : the strength and fragility of their doctrines. Both authors are defined as supporters of the Methodical Realism (Aristotelian-Thomist school), although their arguments and sources are very similar, their purposes and conclusions are different. Juan Vallet does not reject the Human Rights, but he prefers the denomination of ethical-legal principles, that is, moral categories that must guide the legislative and judicial praxis. The root of these ethical-legal principles is the ethical-natural principles extracted at natural order, and the duty of all authority is to adequate his rules to the nature of things, exactly as in Saint Thomas. In Vallet’s works, the theoretical reason for this rejection is that the notion of fundamental right is scientifically unsatisfactory to understand the complexity of the social reality. The practical reason defends that the Civil right should not be confused with the power or faculty of the individual, errors of nominalism, but the origin of these powers is to be found in the context of a particular legal relationship. However, in the end, this catalogue of rights will be not feasible for the citizen, since these rights are at the mercy of the legislator or the judge. They are liable to obey these principles, only morally.

Nuestra hipótesis es la siguiente: Históricamente, las políticas públicas de comunicación ayudaron a construir una posición de desventaja en términos de sostenibilidad económica de los medios comunitarios, populares y alternativos de Argentina, con respecto a los medios de propiedad privada con fines de lucro y a los estatales. Después de una breve etapa entre 2009 y 2015 en la que las políticas dirigidas al sector no lucrativo se orientaron -con sus demoras y problemas- a su legalización y fomento, las políticas del gobierno actual, aunque no modificaron el marco legal, restauran las persecuciones a las radios en situación de ilegalidad forzosa.

This article presents a synthetic and structured view of the determination of law, aligned with the line of thought named methodical realism, which I subscribe. It also offers a critical view of other ius-philosophical lines of thought, which oppose to this rational method of finding what is fair. Nevertheless, the body of the article includes: a) an organized view on the necessity of affronting the judicial decision according to the postulates of the practical reason; b) a study of the different instruments offered to the interpreter for the determination of law; c) an ontological view of Law or the nature of things as the base for legal reasoning; and d) the methodology of the determination of Law, understood as a complex process of factual development and legal reasoning intended to determine what is fair in any particular case.

Given the negative costs of exclusion and the relevance of belongingness for humans, the experience of exclusion influences social affiliation motivation, which in turn is a relevant predictor of prosocial behavior. Skin conductance is a typical measure of the arousal elicited by emotions. Hence, we argued that both inclusion and exclusion will increase skin conductance level due to the increase of either positive affect or anger affects, respectively. Moreover, we argued that emotional arousal is also related to social affiliation motivation and prosocial behavior. A total of 48 students were randomly allocated to either an inclusionary or exclusionary condition and their skin conductance levels were recorded during an experiment in which they completed an online questionnaire and played the game “Cyberball.” Results indicated that (a) individuals who perceived high exclusion felt angrier than individuals perceiving high inclusion, who feel positive affect; (b) no differences were evidenced in terms of skin conductance between exclusion and inclusion situations; (c) over-aroused individuals were less motivated to affiliate; and (d) individuals with lower affiliation motivation behaved in a less prosocial way. The results were congruent to the argument that behaving prosocially may be a way to gain the desired affiliation.

Background:Stress can frequently occur in the driving context. Its cognitive effects can be deleterious and lead to uncomfortable or risky situations. While stress detection in this context is well developed, regulation using dedicated advanced driver-assistance systems (ADAS) is still emergent.Objectives:This systematic review focuses on stress regulation strategies that can be qualified as “subtle” or “mindless”: the technology employed to perform regulation does not interfere with an ongoing task. The review goal is 2-fold: establishing the state of the art on such technological implementation in the driving context and identifying complementary technologies relying on subtle regulation that could be applied in driving.Methods:A systematic review was conducted using search operators previously identified through a concept analysis. The patents and scientific studies selected provide an overview of actual and potential mindless technology implementations. These are then analyzed from a scientific perspective. A classification of results was performed according to the different stages of emotion regulation proposed by the Gross model.Results:A total of 47 publications were retrieved, including 21 patents and 26 studies. Six of the studies investigated mindless stress regulation in the driving context. Patents implemented strategies mostly linked to attentional deployment, while studies tended to investigate response modulation strategies.Conclusions:This review allowed us to identify several ADAS relying on mindless computing technologies to reduce stress and better understand the underlying mechanisms allowing stress reduction. Further studies are necessary to better grasp the effect of mindless technologies on driving safety. However, we have established the feasibility of their implementation as ADAS and proposed directions for future research in this field.

Resumen El proyecto Es.Var.Atenuación se interesa por el estudio de la atenuación pragmática a nivel lingüístico, estructural, enunciativo y situacional, en corpus discursivos del español, a fin de reconocer las posibles estrategias atenuantes de un acto comunicativo. Para llevar a cabo el análisis se parte de una ficha de trabajo (Briz y Albelda, 2013. Una propuesta teórica y metodológica para el análisis de la atenuación lingüística en español y portugués. La base de un proyecto común (ES.POR.ATENUACIÓN). Onomázein, 28, pp. 288–319; Albelda, Briz, Cestero, Kotwica y Villalba, 2014. Ficha metodológica para el análisis pragmático de la atenuación en corpus discursivos del español. (ES.POR.ATENUACIÓN). Oralia, 17, pp. 7–62) organizada en cinco bloques de factores: funciones de la atenuación, procedimientos lingüísticos de la atenuación, factores estructurales, factores enunciativos y factores situacionales. A partir de esta ficha de trabajo, el propósito de nuestra investigación es considerar la implicación del componente fonoprosódico de la lengua, de modo que nos centramos en el segundo bloque de factores de la ficha indicada (Procedimientos lingüísticos de la atenuación). Dicho bloque contiene 22 tácticas lingüísticas (y no lingüísticas) de atenuación; de ellas, la táctica 21 se refiere a los elementos prosódicos, paralingüísticos o gestuales y su papel en la expresión de atenuación. Esta táctica, no obstante, debe ser desarrollada para valorar mejor el peso de lo prosódico en la atenuación; se cuenta para ello con la experiencia previa del proyecto Fonocortesía, donde se manejan parámetros segmentales y suprasegmentales (F0, intensidad, duración, curva melódica o pausa, entre otros parámetros) relevantes para la expresión de (des)cortesía verbal (la atenuación es, de hecho, una forma frecuente de cortesía). El objetivo de este trabajo es, en fin, desarrollar metodológicamente la descripción del componente prosódico en la actividad atenuadora, y precisar a través de parámetros acústicos objetivables en qué pueda consistir ese papel atenuante.
