While Rawls’s theory has often been used to critique inherited wealth inequalities, this paper explores an underexamined possibility: a Rawlsian justification of inheritance. I argue that the right to bequeath can be justified when regulated by the Difference Principle. According to this principle, bequests can be permissible if they function as an incentive that maximally benefits the least advantaged. To meet this condition, I propose a specific inheritance tax design – sensitive to the disincentive effects of receiving large inheritances and the incentive scope of bequeathing – with progressive rates based both on the amount received and the number of transfers.

En este artículo presento y analizo el argumento de la igualdad política para defender el impuesto a la herencia de riquezas a partir de la teoría de justicia de John Rawls. Según Rawls, todos los ciudadanos deben tener una oportunidad aproximadamente igual de acceder a cargos de autoridad y de influir en el proceso político. Estas iguales oportunidades se ven amenazadas cuando las desigualdades económicas superan cierto límite. Como las transmisiones hereditarias explican una parte importante de las desigualdades económicas, es necesario un impuesto progresivo a las recepciones hereditarias para evitar concentraciones de riqueza que amenacen la igualdad política. Para prevenir la conformación de dinastías de poder político, este tributo debe incorporar alícuotas agravadas a las transmisiones intrafamiliares y un sistema de progresividad en el tiempo.

El presente artículo evalúa la legislación argentina sobre servicios de comunicación audiovisual a partir de la teoría política republicana. El abordaje se centró en dos normas de nivel federal: la Ley de Servicios de Comunicación Audiovisual (Ley 26.522) y el Decreto 267/2015. Este trabajo se enmarca en la filosofía práctica de orientación analítica y los métodos utilizados son el equilibrio reflexivo y el análisis conceptual. De esta manera, se hizo una breve reconstrucción del concepto de libertad republicana para, a partir de allí, establecer qué barreras institucionales establece esta tradición y qué marcadores indican el funcionamiento de estas barreras. Luego, se usaron estos marcadores para medir el cumplimiento de las exigencias de esta teoría por parte de la legislación argentina en materia audiovisual. Tras un abordaje de estas instituciones, se concluyó que las normas sancionadas por el gobierno nacional de Cambiemos implicaron un retroceso en términos republicanos.

Why should we recognize people's freedom to bequeath? In this article, I argue that bequeathing should be considered a basic liberty within John Rawls' scheme of justice. To do so, I begin by identifying the characteristics of the interests protected by the basic liberties. These interests are linked to the exercise or development of the two moral powers of persons, must belong to the holder of the right or freedom, and can only be limited by the externalities arising from the exercise of other fundamental interests. Subsequently, I address whether the interest covered by the right to bequeath meets these criteria. Finally, I conclude by establishing that the power to bequeath is a basic liberty that protects the interest of its holder in being partial and that can only be limited if its exercise undermines other fundamental liberties.
