This article examines the theological and anthropological configuration of the human subject during the Renaissance, focusing on the historical and doctrinal controversy between Erasmus of Rotterdam and Martin Luther regarding liberum arbitrium. By combining textual exegesis of erasmian and lutheran sources with patristic (Augustine) and scholastic (Thomas Aquinas) traditions—while tracing modern developments from Molina and Leibniz to Kant, Kierkegaard, Schelling, and Heidegger—the study explores how the defense of a wounded yet operative free will constitutes a foundational pillar for a comprehensive philosophical anthropology centered on human dignity, divine grace, and teleology.

This article examines the tensions between protective legal frameworks—specifically Spain's Organic Law 1/2004 regarding gender violence—and the constitutional guarantees of the rule of law. Drawing on legal theory and philosophy (including contributions by Luigi Ferrajoli, H. L. A. Hart, and Hans Kelsen), the paper analyzes the structural incentives that foster the instrumental use of legal complaints in family law disputes. Furthermore, it proposes a conceptual distinction between false and instrumental accusations, ultimately framing the debate within a broader phenomenological inquiry into fear, state coercion, and the erosion of procedural safeguards.

El presente ensayo examina la progresiva degradación del discurso público y de las instituciones jurídicas a partir del análisis de las respuestas institucionales frente a crisis sociopolíticas recientes. El autor sostiene que Occidente padece un triple vaciamiento normativo y conceptual —caracterizado por la erosión de los enunciados jurídicos, el neopositivismo formalista y el idealismo lingüístico— que ha derivado en una desconexión radical entre el lenguaje y la realidad. Esta deriva se interpreta como una manifestación moderna del docetismo y de la actitud gnostizante (en los términos de Eric Voegelin), mediante la cual la política ideológica suplanta el Lebenswelt («mundo de la vida») y la verdad objetiva por una ficción narrativa. Como conclusión, el texto advierte que una sociedad amordazada por un lenguaje vacío e inoperante es incapaz de articular respuestas eficaces ante los desafíos del orden real, exigiendo la recuperación de un Logos anclado en la facticidad y en la dignidad de la persona concreta.
