En este trabajo tratamos de hilar una mínima dilucidación de eso que se ha dado en llamar postmodernidad, recorriendo para ello algunos de sus síntomas, diagnósticos y expresiones. Pretendemos asimismo mostrar que ese devenir postmoderno, si algo ha de significar, no puede ser un decantarse ajeno al desarrollo de la sociedad de consumo, siguiendo aquí de cerca en algún sentido la tesis de Jameson sobre la postmodernidad como lógica cultural del capitalismo tardío. En efecto, ese tan cacareado desfallecimiento cultural que se rodea de múltiples rótulos postmodernos no puede dejar de estar íntimamente conectado con esa deriva de la sociedad capitalista que ha sido bautizada con etiquetas tales como «capitalismo tardío», «capitalismo postindustrial» o «tardocapitalismo». En ese sentido, también se intenta poner en entredicho el alcance liberador de un pretendido nihilismo lúdico, consumista y humorístico que algunos quisieran celebrar demasiado aprisa, así como señalar el alcance antropológicamente aniquilador de ese nihilismo de la mercancía propio de una cultura enteramente economizada.

We will try to critically examine the processes of constructing a new legal framework which were begun in some Andean states during recent decades and which are characterised by the recognition of the multinational, multiethnic and intercultural character of the Republics, framed hitherto within the homogenising parameters of the creole and mestizo state. These processes have in turn led to the recognition of the rights of the original indigenous peoples and, subsequently, to the establishment of indigenous law with a special jurisdiction. However, this new horizon, despite the fact that it represents a project which is eminently decolonial in many respects, is not without contradictions, frictions or limitations. A scenario of radical legal plurality would lessen the possibility of establishing a common citizenship framework. There are therefore many anthropological, political, legal and philosophical aspects which should be analysed and discussed so as to shed some light on this important issue.
