Richter setzen Rechtsnorm und Sachverhalt in ein Verhältnis zueinander und stützen sich dabei auf ihr Rechtsgefühl. Anstatt hier ein Legitimationsdefizit zu befürchten, vertritt dieser Beitrag die These, dass eine sach- und lebensfremde Auslegung und Anwendung der Rechtsnorm nur durch den Rückbezug auf ein individuell erlebtes Rechtsgefühl vermieden werden kann. Das Rechtsgefühl ist, so das hier vorgebrachte Argument, vor Willkür und privaten Werturteilen der Richter geschützt, wenn es an zwei sich gegenseitig bedingende Standards gebunden ist, nämlich sowohl den normativen Standard (Rechtsidee und Rechtsprinzipien) wie auch den faktischen der fallbezogenen Sachverhalte und kulturellen und politischen Wertegemeinschaft. Ein Blick auf die Konzepte der ästhetischen Normen- und Urteilsbegründung bei Shaftesbury, Hume und Kant verdeutlicht, wie nahe (wenn nicht gar identisch) sich eine in dieser Weise verstandene Rechtsprechung und das Urteil über die Schönheit von angewandter Rechtsordnung und Rechtsprinzipien sind. Die Deutungsoffenheit und normative Stabilität der Rechtsprinzipien ermöglichen pluralistische Interpretationsarten und Lebenswirklichkeiten, ohne aber die Rechtssicherheit in Gefahr zu bringen. Wie bei gelungenen Kunstwerken und einer ihnen angemessenen Interpretation, erreicht eine so konzeptualisierte Rechtsprechung einen breiten Adressatenkreis und steigert somit nicht nur die Transparenz, Ehrlichkeit und demokratische Legitimation der Rechtsordnung, sondern auch ihre Freiheitlichkeit und nicht zuletzt ihre Schönheit.

Kant claims in §59 of his Critique of Judgement that beauty is the symbol of the morally good because the mode of reflection in judgements of beauty is analogous to the mode of reflection in moral judgements. Contrary to common interpretations that often neglect differentiations between kinds of purposiveness, I interpret §59 in light of §17 and argue that the beauty Kant has in mind when talking of the symbol of the morally good is the ideal of beauty rather than merely free beauty. My attempt to make sense of both of the notoriously complex paragraphs (§17 and §59) not only solves the problem of integrating §17 into Kant’s aesthetic theory but also reveals that while Kant’s aesthetic and moral theories are not as dissociated from one another as is often suggested, they are still sufficiently independent from one another so as not to jeopardise their respective autonomies. I show this by relating kinds of freedom with kinds of purposiveness and by interpreting the freedom involved in the judgement of the ideal of beauty as the perfection of the freedom involved in the judgement of free beauty. By showing that the internal objective purposiveness of the ideal of beauty has a moral analogue, whereas the formal subjective purposiveness of free beauty does not, it is possible to show how the morally good can be expressed aesthetically through the ideal of beauty – i.e., through the ‘human figure’. Moreover, this interpretation shows that the normative validity of moral judgements and of judgements of beauty can be grounded on internal objective purposiveness employed as a constitutive and as a mere regulative principle of reflection, respectively, without compromising the role of free play of the cognitive faculties in grounding judgements of beauty in general.

Die philosophische Ästhetik befasst sich nicht ausschließlich mit Fragen der Kunst, sondern allgemeiner mit Problemen der Form-Gebung und der Wahrnehmungs-Vermittlung. Im Recht werden diese Fragen zwar im Rahmen der Methodenlehre gelegentlich berücksichtigt, jedoch steht die evaluative und affektive Überformung von Wahrnehmungen unter einem generellen Subjektivitätsverdacht. Ästhetik im Sinne einer Wahrnehmungslehre ist der geeignete diskursive Ort, um solchen Verdacht als vermittlungsvergessen zu kritisieren. Der Sammelband untersucht anhand einer Vielzahl von Phänomenen, auf welche Weise nicht nur sprachliche, sondern auch performative und mediale Faktoren die Urteilsbildung beeinflussen. Im klassischen Zuschnitt bedenkt die Rechtsphilosophie wohl philosophische Teildisziplinen wie die Ethik oder die politische Philosophie, kaum jedoch die Ästhetik. Im vorliegenden Band werden dagegen rechtsästhetische Forschungsperspektiven als heuristisches Instrumentarium erprobt. Can a person be morally beautiful? Can a character trait, such as honesty, be beautiful and sneakiness ugly or disgusting? Or are such expressions merely metaphorical? Talk of moral beauty has been commonplace since antiquity; and especially 18th-century philosophers used the notion. Yet, a literal meaning quickly leads to Moral judgements based on mere physical appearance, as physiognomists such as Lavater have endorsed. This book assesses influential 18th-century theories of moral beauty and proposes two conditions for a safe literal conception of moral beauty that not only helps justify many moral judgements based on aesthetic Quality but also shows how beauty and moral virtue can be based on the same principles. First, we need an account of why moral beauty and non-moral physical beauty are distinct kinds of beauty; and second, we need an account of how moral beauty can be expressive of moral virtue without identifying the one with the other. The reasons why Shaftesbury, Hutcheson, Hume, and Reid only meet the first condition and why Kant and Schiller meet both conditions are extremely illuminating for current debates on the interactions between aesthetics and moral theory.

Friedrich Schiller’s notion of moral virtue includes self-determination through practical rationality as well as sensual self-determination through the pursuit of aesthetic value, i.e., through beauty. This paper surveys conceptual assumptions behind Schiller’s notions of moral and aesthetic perfections that allow him to ground both, moral virtue and beauty on conceptions of freedom. While Schiller’s notions of grace and dignity describe relations between the aesthetic and the moral aspects of certain determining actions, the ‘aesthetic condition’ conceptualises human beings from the perspective of aesthetic self-determinability. Schiller thereby provides a normative aesthetic standard that not only affects the moral nature of our motives and actions, but also of what we, as human beings, want to and should be conceived of in the first place. As I argue in this paper, considering this aesthetic self-determinability from a moral perspective results in an aesthetic constitution of moral virtue, which in turn justifies aesthetic obligations. Schiller thereby merges the perfections of the two normative domains for an extended anthropological conception of aesthetically infused notion of moral virtue while assuring the conceptual autonomy of each normative domain. Giving aesthetic demands a practical normative role by partly constituting moral virtue and thereby still maintain their aesthetic normative source is a move that opens up many resources for current research on the interactions between various normative demands, such as aesthetic reasons for moral or legal judgements and action, aesthetic obligations or weighing varying sources and elements of normative authority and hegemony against each other.
