This article can be read as an Editorial for the first issue of the Journal of Catalan Intellectual History (JOCIH) in its new stage at de Gruyter Open. It offers, first, a methodical review of the concept, roles, and trends of intellectual history in the 20th century. Next, it looks into the particular Catalan tradition, historiography, and cultural analysis to position the aim and the role of the Journal with regard to similar initiatives. It tries to give an answer to the crisis of intellectual history as a discipline, at the end of the past century. The third part of the article describes some of the available resources. The fourth section introduces the contents of the present issue, focussing on the construction of a collective identity and the literary engagement of Catalan writers between 1920 and 1980, either in their country or in exile. The Notes of the present issue highlight the importance of technology, natural language processing, and Semantic Web developments in carrying out contemporary research in this field.

Although confidence in democracy to tackle societal problems is falling, new Civic participation tools are appearing supported by modern ICT technologies. These tools implicitly assume different views on democracy and citizenship which have not been fully analysed, but their main fault is their isolated operation in non-communicated silos. We can conceive public knowledge, like in Karl Popper’s World 3, as distributed and connected in different layers and by different connectors, much as it happens with the information in the web or the data in the linked data cloud. The interaction between people, technology and data is still to be defined before alternative institutions are founded, but the so called linked democracy should rest on different layers of interaction: linked data, linked platforms and linked ecosystems; a robust connectivity between democratic institutions is fundamental in order to enhance the way knowledge circulates and collective decisions are made.

In this chapter we lay out the properties of participatory ecosystems as linked democracy ecosystems. The goal is to provide a conceptual roadmap that helps us to ground the theoretical foundations for a meso-level, institutional theory of democracy. The identification of the basic properties of a linked democracy eco-system draws from different empirical examples that, to some extent, exhibit some of these properties. We then correlate these properties with Ostrom’s design principles for the management of common-pool resources (as generalised to groups cooperating and coordinating to achieve shared goals) to open up the question of how linked democracy ecosystems can be governed.

Deliberative and epistemic approaches to democracy are two important dimensions of contemporary democratic theory. This chapter studies these dimensions in the emerging ecosystem of civic and political participation tools, and appraises their collective value in a new distinct concept: linked democracy. Linked democracy is the distributed, technology-supported collective decision-making process, where data, information and knowledge are connected and shared by citizens online. Innovation and learning are two key elements of Athenian democracies which can be facilitated by the new digital technologies, and a cross-disciplinary research involving computational scientists and democratic theorists can lead to new theoretical insights of democracy.

This chapter presents Linked Data, a new form of distributed data on the web which is especially suitable to be manipulated by machines and to share knowledge. By adopting the linked data publication paradigm, anybody can publish data on the web, relate it to data resources published by others and run artificial intelligence algorithms in a smooth manner. Open linked data resources may democratize the future access to knowledge by the mass of internet users, either directly or mediated through algorithms. Governments have enthusiastically adopted these ideas, which is in harmony with the broader open data movement.

This chapter introduces the notions of Meta-rule of law and socio-legal Ecosystems to both foster and regulate linked democracy. It explores the way of stimulating innovative regulations and building Rule of lawregulatory quadrant for the rule of law. The chapter summarises briefly (i) the notions of responsive, better and smart regulation; (ii) requirements for legal interchange languages (legal interoperability); (iii) and cognitive ecology approaches. It shows how the protections of the substantive rule of law can be embedded into the semantic languages of the web of data and reflects on the conditions that make possible their enactment and implementation as a socio-legal ecosystem. The chapter suggests in the end a reusable multi-levelled meta-model and four notions of legal validity: positive, composite, formal, and ecological.

OSINT stands for Open Source Intelligence, (O)SI for (Open) Social Intelligence, and PbD for Privacy by Design. The CAPER EU project has built an OSINT solution oriented to the prevention of organized crime. How to balance freedom and security? This chapter describes a way to embed the legal and ethical issues raised by the General Data Reform Package (GDRP) in Europe into security and surveillance platforms. It focuses on the indirect strategy to flesh out ethical principles through Semantic Web Regulatory Models (SWRM), and discusses the possibility to extend them to Cyber Warfare. Institutional design and the possibility to build up a Meta-rule of law are also discussed.

This paper discusses the semiotic dimension of patent interpretation. Patent documents are at the same time disclosure of information and a granting of rights. The claim section expresses the granted rights. In this paper, we view the claims as signs that express the granted rights. The semantics to interpret the signs is given by the all-elements rule, as pragmatics. The description and drawings sections of the patent document provide metapragmatics in the form of lexicon and syntax to help the understanding the claims as signs that express the granted rights. This semiotic approach for patent interpretation has important practical consequences to the correct structuring of a patent document. We highlight this contribution through an instance of a patent application in which a claim includes examples of use. Examples are not allowed in the claim text, as examples do not describe the invention, but consist of metapragmatics to better understand the invention. In this way, examples consist of metapragmatics and belong to the description section of the patent, which has the goal to facilitate the understanding of claims. In the patent application used to highlight our semiotics approach for patent interpretation, the examples initially presented in the claims were rephrased in the final granted patent, significantly reducing the scope of the claim.

This open access book shows the factors linking information flow, social intelligence, rights management and modelling with epistemic democracy, offering licensed linked data along with information about the rights involved. This model of democracy for the web of data brings new challenges for the social organisation of knowledge, collective innovation, and the coordination of actions. Licensed linked data, licensed linguistic linked data, right expression languages, semantic web regulatory models, electronic institutions, artificial socio-cognitive systems are examples of regulatory and institutional design. The web has been massively populated with both data and services, and semantically structured data, the linked data cloud, facilitates and fosters human-machine interaction. Linked data aims to create ecosystems to make it possible to browse, discover, exploit and reuse data sets for applications. Rights Expression Languages semi-automatically regulate the use and reuse of content.

This volume helps us to understand that the current political disorders in Catalonia have deep cultural roots. It focuses on the rise of Catalan cultural, national and linguistic identity in the 20th century. What is happening in Catalonia? What lies behind its political conflicts? Catalan identity has been evolving for centuries, starting in early medieval ages. It is not a modern phenomenon. The emergence of imperial Spain in the 16 c. and the French Ancien Régime in the 17 c. correlates with a decline of Catalan culture, which was politically absorbed by the Spanish state after the conquest of Barcelona in 1714. However, Catalan language and culture flourished again under the stimulus of the European Romantic Nationalism movement. During the first Dictatorship, the Spanish Civil War, and the long Francoist era, Catalan language and culture were repressed, yet refurbished and reconstructed at the same time. This rise of a plural, complex, and non-homogeneous Catalan identity constitutes the subject matter of this volume. National conflicts that emerged later in the Spanish democratic state leant heavily on the life engagement and vital commitment experienced by the entrenched intellectual movements of the twentieth century in Catalonia, Valencian Country and the Balearic Islands. This book reveals the cultural and literary grassroots of these conflicts.

Relationships between empirical and philosophical approaches to the law have not been always peaceful. Agreement seems the most natural way to build up and implementing regulations and justice within human-machine inter-faces (natural and artificial societies), and might help to bridge the gap between both theoretical approaches. Recent researches on relational law, relational jus-tice, crowdsourcing, regulatory systems and regulatory models are introduced. These concepts need further clarification, but they stand as political companions to more standard conceptions of law in the Semantic Web.

The notion of validity fulfils a crucial role in legal theory. In the emerging Web 3.0, Semantic Web languages, legal ontologies, and normative multi-agent systems are designed to cover new regulatory needs. Conceptual models for complex regulatory systems shape the characteristic features of rules, norms, and principles in different ways. This article outlines one of such multilayered governance models, designed for the CAPER platform, and offers a definition of Semantic Web Regulatory Models. It distinguishes between normative-SWRM and institutional-SWRM. It also compares existing principles in privacy by design, linked open data, legal information institutes, and online dispute resolution. The article concludes by proposing the notion of Relational Law to summarize the ethical dimension of SWRM. Ethics are the only regulatory way to constitute a global space, out of the jurisdictional public domain set by national, international, or transnational law, and opposed to the private one.

In the legal domain, ontologies enjoy quite some reputation as a way to model normative knowledge about laws and jurisprudence. This paper describes the methodology followed when developing the ontology used by the second version of the prototype Iuriservice, a web-based intelligent FAQ for judicial use. This modeling methodology has had two important requirements: on the one hand, the ontology needed to be extracted from a repository of professional judicial knowledge (containing nearly 800 questions regarding daily practice). Thus, the construction of ontologies of professional judicial knowledge demanded the description of this knowledge as it is perceived by the judge. On the other hand, due to the distributiveness of the environment, there was a need for controlled discussion and traceability of the arguments used in favor or against the introduction of a concept X as part of the domain ontology. This paper presents the Ontology of Professional Judicial Knowledge (OPJK), extracted manually from the selection of relevant terms from judicial practice questions and modeled according to the DILIGENT methodology. We will show that DILIGENT has proved to be a methodology that facilitates the ontology engineering in a distributed environment, although appropriate tool support needs to be developed.
