This paper examines a recent form of authoritarianism within liberal democratic societies which I call ‘virtue authoritarianism’. This autocratic movement manifests in both a left- and right-wing form, as mirror images of each other, and undermines liberal values within longstanding liberal democracies. Their motive is to force their ‘morally virtuous’ visions of a utopian society upon all citizens. Virtue authoritarians are motivated by the belief that their movements are justified and necessary as they are founded on honourable and righteous motivations and goals, either to bring the society back to a virtuous golden age (right-wing version) or to drive society towards a morally mandated progressive utopia (left-wing version). This paper, firstly, explores the nature of virtue authoritarianism by setting out its nature, aims and methods. Secondly, it offers some thoughts about resisting virtue authoritarianism by suggesting two ways in which liberal democracies could be protected; namely, to reconceptualise fundamental liberal values such as freedom of speech, and to treat the doctrine of liberalism as a fighting creed so developing a more robust and sustained defence against autocratic forces within it.

In J. M. Coetzee’s novel, Waiting for the Barbarians, the main protagonist, the elderly Magistrate of a small frontier town of the Empire, is caught up in an impending war with the so-called barbarians. After witnessing the brutality of Colonel Joll, a member of the Bureau sent by the Civil Guard, the Magistrate puzzles over how Joll is able to torture his victims, yet show no signs of moral pollution. He wonders how Joll felt the very first time he administered torture. Did he “shudder even a little knowing he was trespassing into the forbidden?” Does Joll have a “private ritual of purification, carried out behind closed doors, to enable him to return and break bread with other men?” Does he “wash his hands very carefully, perhaps, or change all his clothes; or has the Bureau created new men who can pass without disquiet between the unclean and the clean?” Later, after being tortured himself, the Magistrate confronts Joll’s sidekick Mandel. This time he demands an answer to his incomprehension.

The aim of this paper is to re-evaluate the manner in which the Ticking Bomb Scenario (TBS), a thought experiment in philosophical enquiry, has been used in the discussion of the justifiability or otherwise of forward-looking interrogational torture (FLIT). The paper argues that criticisms commonly raised against the thought experiment are often inappropriate or irrelevant. A great many criticisms misunderstand the way in which thought experiments in general, and the TBS in particular, are supposed to work in philosophical (and for that matter scientific) inquiry. The paper is not about the acceptability or otherwise of FLIT per se but rather an attempt to show that thought experiments such as the TBS are useful analytic tools and ought not to be rejected due to their inappropriate use by those engaged in the justifiability or otherwise of FLIT. By rescuing the TBS from its erroneous use the paper seeks to show its proper worth as part of an argumentative device in uncovering conflicting moral intuitions in our search for ethical truths.

This paper argues that ‘dirty hands’ (DH) scenarios, where an agent is forced to do wrong in order to do right, are conceptually coherent. The charge of incoherence is a widespread and common criticism made by deontologists and consequentialists alike. They argue that DH theorists erroneously assume the existence of real moral dilemmas and then compound this error by claiming that it is possible to engage in justified moral wrongdoing. However, such critics argue that there are only _prima facie_ moral dilemmas and hence it is not only irrational and obtuse to argue for DH scenarios, but also undermines our search for sound moral judgments in very difficult situations. Given the gravity of these charges, surprisingly little has been written in defence of DH as a coherent and necessary part of our moral vocabulary. If there can be no successful defence of the possibility of DH, then all talk of such scenarios become futile. This paper responds to two influential and what initially appear to be strongly plausible arguments used by critics of DH. I call these the ‘Arguments from Deontic Logic’ and the ‘All-Things-Considered Argument’. I present three responses which seek to raise serious doubts about their efficacy. I then support the possibility of DH by exploring what we can learn about our moral reality from the moral emotion of ‘tragic remorse’. This approach endorses the role of emotions in determining moral knowledge. It also rejects the view that ethical theories ought to dismiss DH experiences as incoherent in favour of questionable theoretical a priori assumptions, which seek a reductionist account of our moral reality.

A recent empirical study has argued that experts in the ethics or the law of war cannot reach reasonable convergence on dilemmas regarding the number of civilian casualties who may be killed as a side effect of attacks on legitimate military targets. This article explores the philosophical implications of that study. We argue that the wide disagreement between experts on what in bello proportionality means in practice casts serious doubt on their ability to provide practical real-life guidance. We then suggest viewing in bello proportionality through the prism of virtue ethics.

Why ought we concern ourselves with understanding a concept of evil? It is an elusive and politically charged concept which critics argue has no explanatory power and is a relic of a superstitious and primitive religious past. When is it justified to refer to someone as evil? How, if at all, is this different from saying that this person is deeply immoral or simply very bad? Moreover, does identifying a person as evil have practical implications for the criminal law and the institution of punishment more generally? His wide-ranging analysis attempts to identify and reliably predict who is, and who will become, evil by clearly understanding what is involved in making such claims. If it is possible to identify evil persons, the hope is that we can begin to design ways to rehabilitate and reform them by improving their characters and/or counteracting their deleterious tendencies. This paper outlines and explores the problem of democratic dirty hands, the sui generis moral situation where democratic politicians justifiably violate both a cherished moral principle and the fundamental processes of democratic governance. Some recent contributions to the dirty-hands debate have argued that the principles of democratic governance render DDH impossible. The paper rejects this view as based on a misunderstanding of the minimal and necessary conditions for both DH and democratic overnance. However, DDH does raise interesting issues concerning the complicity of citizens with their politicians’ DH. Citizens are accessories to such acts and have a duty to contribute to the reparations for the victims of DDH. Furthermore, as citizens bear some responsibility for the moral violations that were done in their name, they properly ought to feel some of the moral pollution that these actions generated.

This paper outlines and defends a notion of tragic-remorse. This moral emotion properly accompanies those actions that involve unavoidable moral wrongdoing in general and dirty hands scenarios in particular. Tragic-remorse differs both phenomenologically and conceptually from regret, agent-regret and remorse. By recognising the existence of tragic-remorse, we are better able to account for our complex moral reality which at times makes it necessary for good persons to act in ways that although justified leave the agent with a moral stain and a particular emotional response.

This paper examines two central arguments raised by feminist theorists against the coherence and consistency of political liberalisms, a recent recasting of liberal theories of justice. They argue that due to political liberalisms' uncritical reliance on a political/personal distinction, they permit the institution of the family to take sexist and illiberal forms thus undermining its own aims and political project. Political liberalisms' tolerance of a wide range of family forms result in two fatal inconsistences. Firstly, it retards or completely prevents women from developing the necessary political sense of self required for citizenship, and secondly, it prevents children from acquiring the requisite political virtues and sense of justice necessary for the viability and long-term stability of such a society. In the paper, I argue that despite their initial appeal these feminist criticisms are not compelling. Firstly, they misunderstand what political liberalisms mean by unjust family forms, secondly, they trade on a misunderstanding of the political/personal distinction and, finally, they make questionable empirical claims about the effects of the illiberal family on a viable political conception of justice.

Should those who get dirty hands be punished? There is strong disagreement among even those who support the existence of such scenarios. The problem arises because the paradoxical nature of dirty hands - doing wrong to do right - renders the standard normative justifications for punishment unfit for purpose. The Consequentialist, Retributivist and Communicative approaches cannot accommodate the idea that an action can be right, all things considered, but nevertheless also a categorical wrong. This paper argues that punishment is indeed appropriate for those who dirty their hands and that there are three normative justifications that can be used to support this claim. These are the justifications from ‘Catharsis’, ‘Recognition of Evil Suffered’ and ‘Causal Responsibility’. Together they provide the sui generis justifications for punishing dirty hands

This article outlines the basic tenets of political liberalism, a recent twist in liberal theories of justice, and distinguishes a?sufficiency? approach from its more?egalitarian? rivals. The article argues that a?sufficiency? principle as the basis for distributing social and material goods, is a logical extension of the commitment to a democratic ideal, one that is required to give substance to political rights guaranteed to all citizens as free and equal members of society. To illustrate the attractiveness of this approach, the paper illustrates how political liberalism offers a compelling way of characterising and interpreting the new South African constitution. As a pluralist society which has until recently been ruled by an unjust regime, political liberalism in general, and the?sufficiency? version in particular, would offer an effective and inclusive way of addressing what ought to be the paramount concern for all citizens: namely, how to prevent the state's coercive powers from being used by one sectarian group to dominate and repress other groups.
