Urgent decision-making during the early COVID-19 pandemic raised complex ethical challenges, in particular concerning how to reach and include marginalized populations. To examine these issues, we conducted a qualitative study based on twenty-three semi-structured interviews with pandemic decision-makers and representatives of marginalized populations in Germany and Israel, focusing on decisions made in 2020 before vaccines were available. Key ethical themes emerged, including decision-making with ethical relevance under intense time pressure, the dominance of biomedical framings often at the expense of social considerations, inadequate attention to populations in bio-psycho-socially vulnerable positions, and the exclusion of stakeholders from decision-making processes. These findings have critical normative significance, highlighting issues of justice in the distribution of burdens and benefits, underscoring the importance of epistemic humility in acknowledging uncertainty and diverse forms of expertise, and affirming the moral obligation to integrate considerations of psycho-social vulnerabilities into public health. To inform future policy, we recommend establishing equitable governance structures to ensure broader stakeholder representation, implementing inclusive communication strategies to reach marginalized groups, and strengthening ethically informed crisis preparedness. Such measures can better align urgent public health decision-making with principles of justice, protection from harm, inclusion, and moral responsibility.

What does it mean to live in asylum? How is health affected by the living conditions in camps and camp-like facilities? And what is unjust about it? Combining philosophical analysis with exploring methods of qualitative research, namely reflexive thematic analysis, this work identifies global pat-terns of the situation in and the space of asylum. Using results of existing empirical public health research as well as a phenomenological approach and the concept of forms of life developed in Social philosophy by Rahel Jaeggi, the interdisciplinary methodology allows to look at the impact of every-day-life conditions, the multifaceted intersectional and ambiguous patterns of in-/exclusion as well as the global political forces shaping asylum. Asylum viewed from - as close as possible - the perspective of having to live in it as a forced form of life and a place shaped by power-asymmetries, control and dependency proves to be an unlivable non-place.

Die Notwendigkeit guter Arzt-Patienten-Kommunikation für eine angemessene Behandlung und für die Ausübung der Patientenselbstbestimmung ist bekannt. In interkulturell-mehrsprachigen Situationen, in denen ein kommunikationsintensiver Aushandlungsprozess besonders notwendig ist, erhält die Qualität der Verständigung besondere Bedeutung, so dass der Einsatz qualifizierter Dolmetschender hier ethisch geboten ist. Er stellt Ärzte und Ärztinnen, aber auch die Dolmetschenden vor besondere, ethisch zu reflektierende Herausforderungen. Sind zudem keine qualifizierten Dolmetschenden einsetzbar, müssen Ärzte und Ärztinnen in schwierigen ethischen Abwägungsprozessen eine Entscheidung über das weitere Vorgehen treffen. Diese beiden Themen finden in der medizinethischen Literatur bisher wenig Beachtung. Anhand von Erkenntnissen aus der Forschung u. a. zum Gesprächsdolmetschen werden im Folgenden zentrale ethische Herausforderungen eines Dolmetschereinsatzes herausgearbeitet. Diskutiert werden der Bedarf sprachlicher Unterstützung, der drohende Ausschluss von Patientinnen und Patienten in gedolmetschten Gesprächen, die Beachtung der für das Dolmetschen geltenden berufsethischen Prinzipien, die Gewährleistung der Vertraulichkeit sowie die Konsequenzen interkulturellen Vermittelns. Des Weiteren wird für Ärzte und Ärztinnen, die unter nicht-idealen Bedingungen ohne qualifizierte Dolmetschende agieren müssen, erstmals ein strukturierter argumentativer Rahmen vorgestellt. Es werden neun Bewertungskriterien vorgeschlagen, anhand derer in einem Abwägungsprozess über die Eignung einer Person zum (spontanen) Dolmetschen entschieden werden kann.
