The aims of this paper are twofold. First, drawing on Miller’s interpretation of Kant’s right of hospitality and his critics at some practice of colinalist, I examine whether eighteenth-century authors such as Wolff and Kant can provide a robust framework to limit the rights of refugees. Second, I compare Kant’s right of hospitality with Wolff’s account of international law. I argue that Wolff’s natural law theory offers more possibilities to ground the rights of refugees than Kant’s right of hospitality. In particular, Wolff allows for the transformation of imperfect rights, such as philanthropy, into perfect duties based on self-preservation. The paper is structured as follows. First, I compare Wolff and Kant on the right to emigrate, with reference to Wolff’s Institutiones Iuris Naturae et Gentium and Kant’s Doctrine of Right. Second, I examine their respective accounts of immigration, the right of hospitality, and colonialism.

Im vorliegenden Text wird die Frage untersucht, ob Pflichten gegen sich selbst moralische Relevanz haben oder, so Habermas, nur als pragmatische Pflichten gelten, da sie lediglich das Interesse der Subjekte betreffen. Die Analyse von Kants Pflichten gegen sich selbst verläuft anhand seiner Moralphilosophie sowie einer Rekonstruktion des naturrechtlichen Ursprungs dieser Pflichten und ihrer Verbindung mit den subjektiven Rechten. Zuletzt wird die Aktualität dieser Pflichten für die zeitgenössische Ethik behandelt. Dafür ist die Interpretation von Adorno, der diese Pflichten und Kants Moral als Ausdruck des Widerstandes des Subjektes gegenüber der Gesellschaft liest, wesentlich. Durch Adornos Interpretation erfasst die Autorin die Pflichten gegen sich selbst als Teil der persönlichen Integrität und des Widerstandes gegenüber der von der Gesellschaft erzwungenen Heteronomie. Dadurch erhalten diese Pflichten nicht nur für die Moral, sondern auch für die Politik Relevanz. Einerseits bezeichnen diese Pflichten in Kants Philosophie die grundlegende Tätigkeit des autonomen Subjektes bei der Entstehung von Moral. Andererseits schützen diese Pflichten die Interessen der Subjekte, die nicht immer mit denen der Kollektivität identisch sind.

This essay examines the theory, advanced by authors such as Bernasconi, Gray, and Lu-Adler, that Kant establishes a “scientific racism” based on the teleological principle. First, we summarize the grounds for these authors’ argument that Kant initiated scientific racism. Second, we examine the role of the teleological principle in Kant’s writings on race and in the Critique of Judgment. Although we argue that teleology cannot provide a basis for scientific racism, we find that Kant used this principle to evaluate the capacity of human beings to cultivate themselves. This shows that teleology, as a principle for realizing freedom in history, still have a specific discriminatory role that is relevant to politics and rights within Kantian philosophy.
