Definition of the problem In residential dementia care, staff face challenges in ensuring residents’ safety and well-being in the face of symptomatic behaviors like spatial disorientation and wandering behavior. To address these challenges, the use of freedom-restricing measures (FRM) is widespread in Germany but raises ethical and legal concerns. Although links between staff’s attitudes and their practices regarding FRM seem plausible, in-depth understanding of their perspectives is lacking. Therefore, this contribution examines how staff perceive the use of FRM in residential dementia care, analyzing the extent to which their perspectives reflect moral problem awareness (MPA) regarding FRM. Arguments Since the concept of MPA has not yet been defined and operationalized, we developed a heuristic framework based on Lawrence Kohlberg’s model of moral development. We conducted a qualitative content analysis of semi-structured interviews with staff in five dementia care facilities in northwestern Germany, representing diverse occupational roles and hierarchical levels (n = 14). The results show that MPA regarding FRM varied considerably. The scope ranges from authority-based and cost-benefit-oriented to relationship-focused and principle-guided argumentations. Staff with pronounced MPA engaged in power-critical reflection, showed consideration for the perspectives and individual rights of residents, and scrutinized institutional practices. Staff basing their reasoning primarily on external directives, legal consequences, or cost-benefit assessments rarely problematized FRM and insufficiently considered the individual freedom of residents. Conclusion The findings highlight the need to enhance staff’s MPA regarding FRM; it should be actively promoted through spaces for ethical reflection, supervision, and the integration of power-critical perspectives in professional education and training.

On December 3, 2024, South Korean President Suk Yeol Yoon declared martial law for the first time in 45 years, suspending ordinary democratic norms and heightening civic uncertainty. This study examines how an elementary teacher and his second-grade students in a rural South Korean school engaged with this moment through a classroom simulation known as “Mr. Kim Law.” Using narrative inquiry, co-authored by the teacher and a researcher–teacher educator, we analyze how children experienced the sudden suspension of ordinary classroom rules, from compliance and fear to collective resistance and restoration of democratic voice. Guided by the dual frameworks of critical civic education and the state of exception, the study illuminates how even young children grappled with injustice, authority, and solidarity in meaningful ways. The findings reveal that children are not merely future citizens, but present civic actors who can recognize and contest arbitrary power when supported by relational trust and democratic school practices. At the same time, the case underscores the dilemmas of democratic education in politically sensitive contexts, where teachers must navigate legal mandates of neutrality while fostering civic agency. By situating the micro-politics of a single classroom within the broader national crisis, this study contributes to scholarship on democratic education under conditions of fragility and demonstrates the potential of narrative inquiry to capture the lived meanings of civic learning.

ABSTRACT This article examines the term kammaṭṭhāna discussed in the Visuddhimagga and the Jiĕ tuō dào lùn or *Vimuttimagga. Although these two texts provide similar lists and expositions for the kammaṭṭhāna, the Visuddhimagga also offers different views and criticisms. The first noticeable difference is in the 10 kasiṇas, which differ in relation to the last two kasiṇas. Furthermore, the Visuddhimagga systematises its own discussion by simplifying or specifying that of the Jiĕ tuō dào lùn and raises some criticisms of views found in the Jiĕ tuō dào lùn in the process. All of these features imply that the discussion of meditative practice, especially of the kammaṭṭhāna, has been diverse within the Theravāda tradition.

Monetary Intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the bright side of Monetary Intelligence and behavioral economics, frames money attitude in the context of pay and life satisfaction, and controls money at the macro-level (GDP per capita) and micro-level (Z income). We theorize: Managers with low love of money motive but high stewardship behavior will have high subjective well-being: pay satisfaction and quality of life. Data collected from 6586 managers in 32 cultures across six continents support our theory. Interestingly, GDP per capita is related to life satisfaction, but not to pay satisfaction. Individual income is related to both life and pay satisfaction. Neither GDP nor income is related to Happiness (money makes people happy). Our theoretical model across three GDP groups offers new discoveries: In high GDP (rich) entities, “high income” not only reduces aspirations—“Rich, Motivator, and Power,” but also promotes stewardship behavior—“Budget, Give/Donate, and Contribute” and appreciation of “Achievement.” After controlling income, we demonstrate the bright side of Monetary Intelligence: Low love of money motive but high stewardship behavior define Monetary Intelligence. “Good apples enjoy good quality of life in good barrels.” This notion adds another explanation to managers’ low magnitude of dishonesty in entities with high Corruption Perceptions Index (CPI) (risk aversion for gains of high probability) (Tang et al. 2015. doi:10.1007/s10551-015-2942-4). In low GDP (poor) entities, high income is related to poor Budgeting skills and escalated Happiness. These managers experience equal satisfaction with pay and life. We add a new vocabulary to the conversation of monetary intelligence, income, GDP, happiness, subjective well-being, good and bad apples and barrels, corruption, and behavioral ethics.

The volume includes the proceedings of the 2nd Roma Sinica project conference held in Seoul in September 2019 and aims to compare some features of the ancient political thought in the Western classical tradition and in the Eastern ancient thought. The contributors, coming from Korea, Europe, USA, China, Japan, propose new patterns of interpretation of the mutual interactions and proximities between these two cultural worlds and offer also a perspective of continuity between contemporary and ancient political thought. Therefore, this book is a reference place in the context of the comparative research between Roman (and early Greek thought) and Eastern thought. Researchers interested in Cicero, Seneca, Plato, post-Platonic and post Aristotelic philosophical schools, history, ancient Roman and Chinese languages could find interesting materials in this work.

Background: In the changing medical environment, professional stress continuously increases as the individual’s quality of life suffers. Of all the healthcare professions, nursing is especially prone to burnout, compassion fatigue and reduced compassion satisfaction, due to the tensions resulting from the physical and psychological stress of caring for extremely ill patients. Objectives: This study examined the professional quality of life of clinical nurses in Korea and the relationship between their experiences in ethical dilemmas and professional values. Methods: This was a cross-sectional study of a convenience sample consisting of 488 clinical nurses. We used four questionnaires to measure the participants’ demographic characteristics, experiences in ethical dilemmas, professional nursing values and professional quality of life (ProQOL assessment, Version 5). Ethical considerations: This study received approval from the Institutional Review Board of Bronco Memorial Hospital. Written informed consent was given by all participants. Results: The nurses’ professional quality of life was affected by ethical dilemmas and professional nursing values. The factors influencing compassion satisfaction were age, client domain of ethical dilemmas, social awareness, professionalism of nursing and the roles of nursing services in professional values. The factors influencing burnout were marital status (married), religion (yes), human life domain, professional work domain of ethical dilemmas, social awareness and the role of nursing services in nursing professional values. The factors influencing secondary traumatic stress were human life domain, client domain and the professional work domain of ethical dilemmas. Conclusion: Intervention to help nurses increase their professional quality of life will have a greater chance of success if they are based on the nurses’ values and beliefs about the ethical dilemmas they face and foster the establishment of positive professional values.

This study investigated the perceptions and attitudes of ICU nurses towards the ‘do not resuscitate’ (DNR) decision and changes in their nursing activities after implementation of the DNR decision in South Korea. A data survey was conducted in South Korea between August and October 2008, with a convenience sample of 252 ICU nurses who had more than one year of clinical experience. The data were collected via a self-administered questionnaire. Most of the nurses perceived the necessity of the DNR decision in cases where there would be no chance of patient recovery despite massive efforts. Very few of the nurses' activities changed, either passively or actively, after implementation of the DNR decision. Moreover, the findings of this research provide suggestions for the future direction of the DNR decision and ethical nursing guidelines in South Korea. Further investigations are needed for the development of decision-making skills and intervention guidelines for end-of-life nursing.

Research on recruitment shows that jobseekers display positive attitudinal and behavioral responses to potential employers' corporate social responsibility (CSR), while corporate social irresponsibility (CSI) works contrariwise. However, few studies have examined how jobseekers react to companies that show the two attributes in an inconsistent way. This study investigates how jobseekers' perceptions of a company, shaped by its CSR history, are changed based on its recent CSR/CSI practices. It also examines how jobseekers' moral traits affect their perceptions of and behavioral intentions toward the company, influenced by the (in)consistency of its CSR. The results of a scenario-based experiment with 203 subjects show that jobseekers perceive a company with a strong (vs. weak) CSR history as warmer and infer that its CSR motive is genuine. However, when they obtain information about the company's recent CSI practices, they tend to perceive that the motivation of the previous CSR is not genuine and are less likely to be attracted by the company. This tendency is amplified when the jobseekers have a strong propensity to belong to ethical organizations. This research contributes to the literature on the effects of the (in)consistency of a company's CSR on its external stakeholders.

EC 제소의 선박산업에 대한 보조금지급에 관한 한국과 EC 간의 通商紛爭에 관 하여 패널결정을 선고하였으며, 양국의 항소포기로 인하여 4. 12. 분쟁해결기구가 동 결정을 채택하고 그 이행에 관하여 감시하고 있다. 즉, WTO는 제소국인 EC가 대한민국의 수출입은행법 및 동법 시행 령, 동 법령에 근거한, 개별적 특혜조치, 대우, 한라, 대동 등 우리 나라 주요 조선기업에 대한 특혜적 구조조정이 WTO가 허용하지 않는 금지보조금 및 조치가능보조금에 해당한다고 주장하면서 대한민국 정부를 상대로 제소한 통상분쟁과 관련하여 대부분 EC의 주장을 배척하고 일부 개별적 거래가 WTO 의 보조금 및 상계조치에 관한 협정에 위반한다는 결정을 내린 것이다. 이에 따라 WTO는 피소국인 대한민국에게 지체없이 동 일부 특혜조치 등을 철회할 것을 권고하였고, 대한민국 정부는 이를 이행할 의무를 부담하게 되었다. 본 사안을 통하여 WTO는 보조금 및 상계조치에 관한 해석론상의 많은 쟁점들에 관하여 法理的 견해 를 밝혔다. 첫째, 동일한 사실관계에 관하여 금지보조금과 조치가능보조금의 주장이 중첩적으로 가능하 고, 둘째, 전통적인 재량행위론, 즉 법령조항의 기속행위성 여부가 정부나 공공기관의 재정적 공여요건 의 충족 여부에 관한 판단의 기초를 제공하며, 셋째, 소위 SCM협정 예시목록의 법적 성격, 넷째, 재정 적 공여 요건과 특혜요건의 준별, 다섯째, 중대한 손상요건과 관련하여 보조금 해당요건과 국내 상계관 세부과조치의 준별, 여섯째, 보조금해당 여부의 판단에 있어 ‘ 동종물품요건’ 의 적용문제, 일곱째, 조치가 능보조금의 태양으로서 가격유지 및 왜곡된 가격인하의 개념 및 보조금요건충족과의 문제 등이 그것이 다. 본 논문은 우리의 주요 수출산업인 조선산업과 관련하여 이러한 쟁점들에 대한 WTO 결정의 의미 를 검토하였는바, 국제통상규범과 관련하여 향후의 무역분쟁에 대한 대비에 일조할 수 있었으면 한다.

The study’s purposes were: (a) to examine the phenomenon inherent in the public administration of Korean judicial system (b) to generate a theory on its phenotype in the national and comparative or interdisciplinary viewpoints. 3. Based on the grounded theory approach as well as hermeneutics and heuristics, the kind of tools, i.e., concepts, terms, essences as well as inter-relational understanding or themes were employed. The theories and tenets generally on the elements of public policy, as stems from Sabatier & Mooney, Walzer, Habermas & Foucault, Weber &Turner, Simons, Bourdieu and so, provided the backdrop for this study. 4. Research questions focused on the policy process and actions, interactions of players within the public policy aspect of Korean judicial system and its phenotype in terms of national and comparative or interdisciplinary viewpoints. 5. Research participants consisted of a purposive sample of 30 Korean lawyers, legal historians, law professors and civic leadership who responded with the individual in-depth interviews. They were preliminarily surveyed with the written questions leading to select major occurrences or events, and deeply investigated through the interviews at next. The data collection consisted of public documentation, record, personal writings, and texts of Korean source 6. The findings indicated that the public administration of Korean judicial system in view of public policy elements is (i) unique, but sharable (ii) inevitable, but struggled, (iii) static, but transformative (iv) general, but professional. 7. On the other hand. regional integration creates economic benefits as illustrated by the creation of the EU and NAFTA. East Asia has also seriously pursued prospects for economic integration. producing considerable successes thus far. A Free Trade Agreement is a useful tool to assist in this evolution of trade relations. and South Korea. one of the major economies in East Asia. is uniquely situated to play a significant role in future negotiations. From this perspective. this paper surveys the global structure and organization of international trade. problems of regional economic integration emphasizing East Asia. and attempts to articulate a plausible South Korean strategy.

The paper aims to briefly look into the civil law remedies of CISG from the perspective of economic efficiency. It mainly illustrates the basic tools of remedies in CISG, and discusses its strengths and flaws from the standpoint of economic deals normally present in most of commercial transactions. As many literature have long contributed to the legal economic discourse, our discussion, as a matter of course, largely depends on the current stronghold, or prospect that those theories espouse. Generally, the remedies in CISG have two basic pathways addressing or penalizing the breach of contract from one party, namely specific performance and damages award. Other instruments to deal with the breach of contract cover a cure of defect, repudiation to perform a contract, additional period to perform a contractual duty, avoidance of contract and etc. This group of instruments can be classed as a privately administered remedies for our purpose of analysis. On this assumption, we can find many aspects of strengths in economic terms, but some paucity that the prescribed approach cannot properly address the best of economics between the contracting parties. This paucity comes mainly because the lawmakers normally could not pre-consider all circumstances among the individual contracting parties. For this reason, this paper argues in favor of privately administered remedies to fill the paucity of two typical remedies. Moreover, the contractual negotiation or design of contract is considered very important as the contracting parties are most informed about their best of economics besides the official lawmakers. The paper concludes with a short discussion of the electronic commerce in comparison with the traditional domestic and international commerce.

In retrospect of Hague convention on international sale of goods, the efforts had been poured in the initiative of UNCITRAL since 1968 triggering more welcome international treaty on the area of law. The efforts came to reality where the committee in action, comprised of 14 countries, concluded a final draft in 1978. In 1980, it was adopted as United Nations Convention on Contracts for the International Sale of Goods(CISG). While the treaty is deemed a marvellous success within the purview of uniform private laws, it is also true that there arises a severe criticism. One of criticism points to imprecise and ambiguous terms CISG employs that harms the uniformity in its interpretation. However, I would support the strength of CISG that CISG can be interpreted consistently in itself in terms of its international character, which means imprecision of CISG, short coverage of hardship issues, imbalance between parties, and inept nature to commodity transactions. In support of CISG, these criticisms either overlook the intrinsic difficulties underlying production of the uniform laws or seems to be groundless on various points of views. On the other hand, the true uniform laws presuppose uniformity in the application of treaty. We can see some extent of difference in terms of the role of precedents between the common law and civil law countries. It is encouraging that the recent practice of civil law countries, including Italy, Poland, Denmark and so on, tend to cite the foreign precedents for the cases of CISG laws. Within the regime of common law countries, the rule of “stare decisis” prescribes that the national precedents should govern as binding authority while those of other common law countries function to be a persuasive authority. This means that the practice of civil law countries has considerably developed as similar to that of common law counterparts. While they seem to use foreign precedents as persuasive authority like their counterparts, or in the least accept as inspirational authority, the application of CISG grows to be made in a shared fashion for true uniform laws. This development seems to prosper at the advent of academic database as well as the contribution of CISG experts.
