A transparência é um velho ideal moderno que as novas tecnologias rejuvenesceram e tornaram onipresente nas discussões atuais sobre poder, cultura digital e controle. Neste artigo, propomos uma análise da noção de transparência ao longo de quatro obras do filósofo contemporâneo Byung-Chul Han: Sociedade do cansaço, Topologia da violência, Sociedade da transparência e Psicopolítica. Este percurso nos permitirá sugerir uma genealogia desta noção na obra de Han. A noção de transparência será analisada como desdobramento da sociedade de desempenho, como forma de violência, como fenômeno econômico e cultural e como dispositivo neoliberal. Tais abordagens propostas por Han supõem uma mudança do paradigma disciplinar elaborado por Foucault: assim a sociedade contemporânea seria mais uma sociedade do desempenho que uma sociedade disciplinar. Em nossas considerações finais, pontuaremos algumas críticas ao livro Psicopolítica. Se a transparência é um dispositivo que gera uma visibilidade seletiva para reproduzir uma ordem neoliberal, um discurso crítico sobre a transparência não deveria invisibilizar as concepções que se contrapõem a esse dispositivo. Nesta direção, aventamos quatro perspectivas que agrupam linhas de ações coletivas e individuais que confrontam o dispositivo neoliberal da transparência.

Ich behaupte, dass Hegel in seinen Werken zwei unterschiedliche hermeneutische Ansätze anwendet, nämlich den assimilativen und den rekonstruktiven Ansatz. Ich charakterisiere sie, und erkläre, warum Hegel beide verwendet, sowie ich auf ihre Voraussetzungen eingehe. Im Zuge dieser Überlegungen gehe ich auf den angeblichen Widerspruch zwischen Hegels Reflexionen zur Interpretation und ihrer Anwendung ein. Konträr zu einem Teil der Literatur, argumentiere ich, dass Hegels hermeneutische Praxis nicht von seinem theoretischen Interpretationsansatz abweicht. Dann konzentriere ich mich auf die Frage, ob und inwieweit diese beiden Ansätze intellektuell demütige Praktiken sind. Ich behaupte, dass nur der rekonstruktive Ansatz in der Phänomenologie intellektuell demütig ist, im Gegensatz zum assimilativen Ansatz in Hegels Vorlesungen.

The case of Copeland v Baskin-Robbins, USA has major implications for pre-closing negotiations in the State of California, and the US generally, but what, if anything, does it mean for the European Commission's ongoing 'Common Frame of Reference' strategy aimed at removing problematic divergences and inconsistencies between European contract laws? Commercial bargaining, incomplete contracts and the spectre of precontractual reliance remain a significant, if largely neglected, challenge for emergent EC contract rules, yet does Copeland provide a lead on how best to police the formation of international commercial agreements or merely represent a further weakening of party autonomy for those seeking to drive the hardest bargain? In this paper the author explores the world of almost contract, the 'contract' to bargain in good faith and looks beyond the current resistance of the English common law to sketch the parameters of a new EC reliance doctrine.

Mientras el carácter de la alta educación como medio de vida es sólo accesible para la reproducción de la burguesía y de las capas acomodadas de la pequeña burguesía, funge también dominantemente como asiento de un título bajo el cual estas capas puedan apropiarse de una parte de la riqueza social producida. Por eso, la pérdida de este carácter puede constituirse en el indicador de algún grado de descomposición de estas capas. La forma en que se presenta más abiertamente esta situación es en la posibilidad del desempleo de los graduados superiores, aunque también se podría extender a todas aquellas situaciones en que las categorías que se formaron para ejercer funciones intelectuales no pueden insertarse efectivamente en dichas actividades. ¿Puede estar asociada esta situación a un proceso de proletarización? Con esta pregunta como guía, el artículo presenta una serie de reflexiones a partir de un ejercicio de análisis del peso y la composición de los egresados de educación superior en Argentina, particularmente de aquellos no insertos en ocupaciones tradicionalmente adjudicadas a la pequeña burguesía acomodada. Los datos proceden del procesamiento de información a partir de la Encuesta Anual de Hogares Urbanos 2010 y 2012.

Inheritance is normally distributed to the heirs, but during the 20th century the state claimed a share of the estate through inheritance taxation. The purpose of this article is to examine how the successively increased importance of inheritance taxation in Scandinavia was justified in political debate between 1890 and 1935. The results shows that the tax was mainly motivated by the state’s increased revenue needs. The tax was not controversial in Denmark or Sweden, but caused strong conflicts in the Norwegian debate.

Providing a rich combination of theoretical resources, methodological approaches and empirical investigation, each of the chapters takes a distinct aspect of touch within a particular spatial context, exploring this through a mixture of sustained empirical work, critical theories of embodiment, philosophical and psychoanalytic approaches to gendered touch and touching, or the relationship between visual and non-visual culture, to articulate something of the variety and variability of touching experiences.
